Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Report of Separation from Active Duty) for the period ending 11 April 1974 to show her rank as specialist four (SP4). 2. The applicant states her rank is not correct on her DD Form 214. She has orders that show she was promoted to E-4; those orders are attached with her request. She respectfully requests correction of her DD Form 214 to show the appropriate rank at her time of discharge; she was told it could not be changed. 3. The applicant provides a copy of her DD Form 214 and Unit Orders Number 12, issued by Headquarters Company, U.S. Army Reception Station, Fort Ord, CA, on 7 March 1974. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 2 October 1972. 2. Item 33 (Appointments and Reductions) of the applicant's DA Form 20 (Enlisted Qualification Record) shows the following promotions and dates of rank: * Private (PV1) – 2 October 1972 * Private (PV2) – 2 February 1973 * Private First Class (PFC) – 5 October 1973 3. Special Orders Number 98, issued by Headquarters, U.S. Army Training Center and Fort Ord, on 8 April 1974, shows the applicant was reassigned to the Transfer Point for separation. These orders show her rank as PFC. 4. A DA Form 3082-R (Statement of Medical Condition), dated 11 April 1974, shows the applicant wrote her rank as PFC and signed the form. 5. The applicant was honorably discharged on 11 April 1974. She signed her DD Form 214, which shows in: * Item 6a (Grade, Rate or Rank), her rank upon separation was "PFC" * Item 6b (Pay Grade), her grade upon separation was "E3" * Item 7 (Date of Rank), her date of rank upon separation was "73 10 05" 6. The applicant's record is void of evidence that shows she was promoted to SP4 at any time. 7. The applicant provides Unit Orders Number 12, issued by Headquarters Company, U.S. Army Reception Station, Fort Ord, CA on 7 March 1974, which shows she was promoted to SP4 effective 7 March 1974. On 7 March 1974, she had 17 months and 5 days of time in service, and 5 months and 2 days of time in grade as PFC. REFERENCES: 1. Army Regulation 600-200 (Enlisted Personnel Management System) in effect at that time, shows the criteria for promotion to E-4 as: * Time in service – 24 months waiverable to at least 15 months * Time in grade – 6 months waiverable to at least 3 months 2. Army Regulation 635-5 (Separation Documents) at the time established the standardized policy for preparing and distributing the DD Form 214. It states the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate, reflective of the conditions as they existed at the time of separation. DISCUSSION: 1. The applicant enlisted in the Regular Army on 2 October 1972 and was promoted to PFC on 5 October 1973. She was eligible for promotion to SP4 on 7 March 1974, if the promotion authority approved a waiver for her time in service and a waiver for her time in grade as a PFC. 2. The applicant provided evidence that shows she was promoted to SP4 a month prior to her date of separation. However, the evidence of record shows she was identified as a PFC throughout her remaining service until her separation date. Her DD Form 214 shows her rank as PFC and she authenticated the form with her signature. 3. The applicant provides orders that show she was promoted to SP4 prior to her date of separation.
