Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of the Army Board for Correction of Military Record's (ABCMR) decision document and its associated Record of Proceedings, dated 12 July 2012, from her official military personnel file (OMPF). 2. She states only the letter of non-rated time, not the ABCMR decision and Record of Proceedings granting full relief, should be filed in her records. She states these documents are improperly filed in the restricted folder of her Interactive Personnel Electronic Record Management System (iPERMS) and the performance folder of her U.S. Army Human Resources Command (HRC) Soldier Management System (SMS) records. She cites guidance from the U.S. Army Human Resources Command website as her source to support her request. 3. She provides: * ABCMR Docket Number AR20110016522, dated 12 July 2012 * list of the documents filed in her IPERMS and SMS records * extract from Army Regulation 623-3 (Evaluation Reporting System) CONSIDERATION OF EVIDENCE: 1. On 10 July 2012, the ABCMR recommended removal of her officer evaluation report (OER) for the period 6 July 1998 through 3 January 1999 and adding a memorandum explaining the non-rated time for the same period in Docket Number AR20110016522. 2. The ABCMR Record of Proceedings in Docket Number AR20110016522, dated 12 July 2012, with allied documents is currently filed in the restricted folder of her iPERMS, as well as her SMS records. 3. She provided an extract from Army Regulation 623-3, chapter 6, which describes the processing, resolution, and filing of performance evaluation appeals submitted for redress at various levels of command. The Evaluation Redress Program detailed in this chapter does not include the remedies and relief possible through applications (not an appeal) to the ABCMR. REFERENCES: Army Regulation 600-8-104 (Army Military Human Resource Records Management (AMHRR)) provides the principles of support, standards of service, policies, tasks, rules, and steps governing all work required to support maintaining the OMPF. The OMPF is defined as permanent documentation within the AMHRR that documents facts related to a Soldier during the course of his or her entire Army career, from time of accession into the Army until final separation, discharge or retirement. a. Chapter 2 provides detailed guidance and instructions regarding the initiation, composition, maintenance, changing, access to, and transfer of documents in the OMPF. b. Appendix B (Documents Required for Filing in the AMHRR and/or iPERMS), shows ABCMR decisions, record of proceedings, memorandum or letter, and applications (with continuation pages when provided) will be filed in the restricted folder unless otherwise directed by the ABCMR. DISCUSSION: The purpose of maintaining the OMPF is to protect the interests of the Army and the Soldier. The applicant has misinterpreted her application to the ABCMR to be an appeal as outlined in Army Regulation 623-3.
