Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his records to show his home of record (HOR) as Texas. 2. The applicant states his current HOR is Helena, Alabama. He requests his HOR be changed to Fort Sam Houston, Texas, because he recently reenlisted in Texas and he wants to establish Texas as his HOR. 3. The applicant provides a copy of his reenlistment contract. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the U.S. Army Reserve (USAR) on 13 April 2001 for a period of 8 years. Item 3 (HOR) of his DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States) shows an address in Monroeville, Alabama. 2. Documentation of his 2009 reenlistment/extension in the USAR is not in his available records. His records show he served in the USAR until 23 March 2011. 3. He enlisted in the Regular Army (RA) on 24 March 2011 for a period of 4 years. Item 3 of his DD Form 4 shows an address in Helena, Alabama. Items 3 (Current Address) and 4 (HOR) of his DD Form 1966 (Record of Military Processing – Armed Forces of the United States), dated 24 March 2011, show an address in Helena, Alabama. 4. He was honorably discharged on 20 November 2013 for immediate reenlistment. He reenlisted in the RA on 21 November 2013 for a period of 3 years. Item 3 of his DD Form 4 shows an address in Helena, Alabama. 5. He was honorably discharged on 17 February 2016 for immediate reenlistment. He reenlisted in the RA on 18 February 2016 for a period of 6 years. Item 3 of his DD Form 4 shows an address at Fort Sam Houston, Texas. REFERENCES: 1. Army Regulation 601-210 (Active and Reserve Components Enlistment Program) provides that the HOR address (street, city, county, state, country, and zip code) will be entered item 4 of the DD Form 1966. The instructions state, "Do not enter a temporary address." The address must be in the continental United States or a U.S. Territory. 2. Army Regulation 601-280 (Army Retention Program) states the term "home of record" means the place (city and state or country) recorded as the home of the individual when commissioned, reinstated, appointed, reappointed, enlisted, reenlisted, inducted, or ordered into the relevant tour of active duty. An HOR can only be changed if there is a break in service of more than 1 day or to correct an error. 3. The Joint Travel Regulations state the HOR is the place recorded as the home of the individual at the time of enlistment or induction. There is no authority to change the HOR as officially recorded at the time of entry into military service. However, there is authority to correct an HOR if erroneously entered on the records at that time and then only for travel and transportation purposes. Correction of the HOR must be based on evidence that a bona fide error was made and the HOR as corrected must have been the actual home of the individual at the time of entry into the relevant period of service. It may not be a place selected for the convenience of the Soldier. DISCUSSION: 1. The applicant's request for correction of his records to show Fort Sam Houston, Texas, as his HOR because he recently reenlisted in Texas and he wants to establish Texas as his HOR was carefully considered. 2. The governing regulation clearly states a temporary address is not an authorized HOR. Fort Sam Houston is a duty station and cannot be considered a permanent address for HOR purposes. 3. The Joint Travel Regulations provide that an HOR may only be corrected if a bona fide error can be established. 4. The evidence of record shows: a. He enlisted in the USAR on 14 April 2001 and was discharged on 23 March 2011. b. He enlisted in the RA on 24 March 2011 and was honorably discharged on 20 November 2013 for immediate reenlistment. c. He reenlisted in the RA on 21 November 2013 and was honorably discharged on 17 February 2016 for immediate reenlistment. d. He reenlisted in the RA on 18 February 2016. 5. He did not incur a break in service. 6.
