Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 11 (Primary Specialty) of her DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states: a. Item 11 of her DD Form 214 shows the entry "91B3O 00 MEDICAL SPECIALIST -- 4 YRS - 4 MOS//NOTHING FOLLOWS." The entry should show "75D2O 00 MILITARY PERSONNEL RECORDS SPECIALIST -- 4 YRS - 4 MOS, 91B3O 00 MEDICAL SPECIALIST -- 4 YRS - 4 MOS//NOTHING FOLLOWS." b. It's as if her first 4 years and 4 months of service in military occupational specialty (MOS) 75D (personnel records specialist) never happened. This MOS is not reflected on her DD Form 214, only her last enlistment in MOS 91B is annotated on her DD Form 214. 3. The applicant provides a copy of her DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 8 August 1986 for a period of 4 years and MOS 75D. Her DA Form 2-1 (Personnel Qualification Record – Part II) shows she attended: * basic combat training from 9 September 1986 to 6 November 1986 * advanced individual training from 7 November 1986 to 15 December 1986 3. On 22 March 1990, she was honorably discharged for immediate reenlistment. She reenlisted on 23 March 1990 for a period of 4 years and MOS 91A (medical corpsman). 4. Her records contain a certificate from the National Registry of Emergency Medical Technicians, dated 7 December 1990, showing she was certified as an emergency medical technician. 5. Headquarters, Defense Language Institute, Orders 234-1, dated 18 December 1990, promoted her to sergeant in primary MOS 75D2O00OO effective 1 January 1991 and withdrew primary MOS 75D1O00OO. 6. Her DA Form 2166-7 (Noncommissioned Officer Evaluation Report) covering the period January 1991 through December 1991 shows her MOS as 91B3O. 7. On 1 May 1995, she was honorably discharged. She completed 8 years, 8 months, and 24 days of active duty service during this period. 8. Item 11 (Primary Specialty) of her DD Form 214 shows the entry "91B3O 00 MEDICAL SPECIALIST -- 4 YRS - 4 MOS//NOTHING FOLLOWS." 9. Item 14 (Military Education) of her DD Form 214 shows she completed the 8-week Personnel Records Specialist Course in 1986. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions for item 11 stated to enter the titles of all MOS's served (clarified by the U.S. Army Human Resources Command to mean held) for at least 1 year from the Enlisted Record Brief and include the number of years and months served for each MOS. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training. DISCUSSION: 1. Army Regulation 635-5, in effect at the time, stated to enter the titles of all MOSs awarded and held for at least 1 year during the current period of service and include the number of years and months held for each MOS in item 11 of the DD Form 214. The instructions stated do not count basic training and advanced individual training. 2. The evidence of record shows: * she attended basic combat training from 9 September 1986 to 6 November 1986 (8 weeks) * she attended advanced individual training from 7 November 1986 to 15 December 1986 (5 weeks) * she completed the emergency medical technician requirements on 7 December 1990 and she held MOS 91B3O and served in this MOS beginning in January 1991 * the only MOS shown in item 11 of her DD Form 214 is 91B3O 00 3. The evidence indicates she held MOS 75D from the time she completed advanced individual training in mid-December 1986 until January 1991. Item 11 of her DD Form 214 does not show she held MOS 75D2O 00 for 4 years (period of service, less basic and advanced individual training).
