Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her records to show her home of record (HOR) as "Burlingame, CA" instead of "Temple, TX." 2. The applicant states her HOR, as shown in her records, is the location where she attended and graduated medical school. However, she was actually recruited into the military and accepted a scholarship while in Burlingame, CA. She did not understand the significance of HOR when she graduated medical school and what it would mean for her when she eventually separated. 3. The applicant provides: * U.S. Army Recruiting Command (USAREC) Form 1131 (Department of the Army Service Agreement – F. Edward Hebert Armed Forces Health Professions Scholarship Program (AFHPSP)), dated 13 February 2002 * DA Form 61 (Application for Appointment), dated 26 February 2002 * Orders C-05-212276, issued by the U.S. Total Army Personnel Command (TAPC), St. Louis, MO on 2 May 2002 * Orders 085-1116, issued by Headquarters, U.S. Army North (Fifth Army), Joint Base San Antonio (JBSA), Fort Sam Houston, TX on 25 March 2016 CONSIDERATION OF EVIDENCE: 1. On 6 February 2002, the applicant was appointed as a Reserve commissioned officer of the Army, in the rank/grade of second lieutenant (2LT)/O-2. Her Oath of Office was administered in Burlingame, CA. 2. Orders C-05-212276, issued by TAPC on 2 May 2002, assigned her to the USAR Control Group (Officer Active Duty Obligor (OADO)), effective 6 February 2002. These orders show her address at the time was in Burlingame, CA. 3. Orders A-03-607358, issued by the U.S. Army Human Resources Command (HRC) on 27 March 2006, ordered her to active duty at Brooke Army Medical Center, Fort Sam Houston, TX, with a report date of 11 June 2006. These orders show her address at the time as Temple TX, and her HOR is listed as "same as [standard name line] SNL." 4. On 20 May 2006, she was appointed as a captain in the Regular Army and she executed an Oath of Office at College Station, TX, on that same date. She entered active duty on 11 June 2006. 5. Orders 085-1116, issued by Headquarters, U.S. Army North (Fifth Army), JBSA, Fort Sam Houston, TX on 25 March 2016, reassigned her to the U.S. Army Transition Point, JBSA, effective 30 September 2016. These orders show her HOR as Temple, TX. 6. In support of her application, she provides a DA Form 61, dated 26 February 2002, wherein she listed her permanent mailing address and current mailing address as Burlingame, CA. REFERENCES: 1. Army Regulation 600-8-104 (Army Military Human Resource Record Management) prescribes the policies governing the official military personnel file. Table 5-2 of this regulation states the term "HOR" means the place (city and state or country) recorded as the home of the individual when commissioned, reinstated, appointed, reappointed, enlisted, reenlisted, inducted, or ordered into the relevant tour of active duty. 2. Army Regulation 635-8 (Separation Processing and Documents), paragraph 5-6g (2), states a Soldier's initial enlistment contract or appointment document is the source data for his or her home of record, or any correction approved by HRC. A Soldier's HOR is defined as the place they record as their home of record at the time they are commissioned, appointed, enlisted, or ordered to a tour of active duty. This cannot be changed unless there is a break in active service of at least 1 day, or it is determined by HRC to be factually incorrect. DISCUSSION: 1. The applicant's request to correct her records to show her HOR as "Burlingame, CA" instead of "Temple, TX" was carefully considered. 2. Upon her appointment as a Reserve commissioned officer, she was residing in CA and listed CA as her permanent address. Later, upon her appointment as a Regular commissioned officer in 2006 and her subsequent entry on active duty, her orders incorrectly listed her HOR as "Temple, TX" instead of "Burlingame, CA." She did not have a break in service. 3.
