Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 29 September 2003 to show her primary specialty as 66F (Nurse Anesthetist) instead of 66H (Medical Surgical Nurse). 2. The applicant states that when she was released from active duty, her primary military occupational specialty (PMOS)/area of concentration (AOC) was incorrectly identified as 66H. Her PMOS/AOC is and always has been 66F. She was ordered to active duty in the PMOS/AOC of 66F and she informed the person preparing the DD Form 214 that the listed PMOS/AOC was incorrect at the time; however, they were unable to find it in the system in order to change it. 3. The applicant provides: * U.S. Army Reserve (USAR) Personnel Command (ARPERSCOM) Memorandum, dated 27 August 1998, subject: Award of Classification Identifiers for Army Medical Department (AMEDD) Officers * Headquarters, U.S. Army 77th Regional Support Command (RSC) Orders M-043-0008, dated 12 February 2003 * North Atlantic Treaty Organization (NATO) travel orders, dated 8 April 2003 * Annex A1 to Headquarters, U.S. Army Fort Dix Permanent Orders 098-002, dated 8 April 2003 * DD Form 214, for the period ending 29 September 2003 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was appointed as a Reserve commissioned officer of the Army on 10 August 1996, as a first lieutenant in the Army Nurse Corps. She is currently a member of the USAR serving in the rank of lieutenant colonel. 3. A memorandum from ARPERSCOM, dated 27 August 1998, subject: Award of Classification Identifiers for AMEDD Officers, shows she was awarded the AOC 66F. 4. Headquarters, U.S. Army 77th RSC Orders M-043-0008, dated 12 February 2003, ordered the applicant to active duty in support of Operation Enduring Freedom (OEF) effective 11 February 2003. These orders show her PMOS/AOC as 66F. 5. The applicant entered active duty on 11 February 2003. 6. The applicant's record includes a DA Form 638 (Recommendation for Award) that shows she was awarded the Army Commendation Medal (ARCOM) for meritorious service as a Certified Registered Nurse Anesthetist during the period 11 February to 21 August 2003, during Operation Iraqi Freedom (OIF)/OEF. 7. The applicant was released from active duty on 29 September 2003. Her DD Form 214 for this period of active duty shows her primary specialty as 66H. REFERENCES: Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. DISCUSSION: 1. The applicant was ordered to active duty effective 11 February 2003, with duties in PMOS/AOC 66F. The evidence of record shows she was awarded an ARCOM for meritorious service as a Certified Registered Nurse Anesthetist during the period 11 February to 21 August 2003. 2.
