THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal from his Official Military Personnel File (OMPF) a copy of a citation awarding him the Navy and Marine Corps Achievement Medal, dated 10 December 2013. 2. The applicant states, in effect, in accordance with Army Regulation 600-8-22, paragraph 1-37a, he was not authorized to receive another military service's award. 3. The applicant provides a copy of a Navy and Marine Corps Achievement Medal Certificate. CONSIDERATION OF EVIDENCE: 1. With prior enlisted service in the United States Army Reserve (USAR) the applicant accepted an appointment as a Reserve Commissioned Officer on 12 June 1988, in the rank of second lieutenant. He was promoted to first lieutenant on 30 November 1999, to captain on 1 December 2001, to major on 1 January 2008. 2. A review of the available records show that from 5 June 2011 through 23 April 2012, the applicant was assigned to the 602nd Senior Contingency Contracting Team, Fort Carson, Colorado, and the Contingency Contracting Teams Team Leader and Deputy Director. As a result, he taught the first ever Marine Corps Regimental Combat Teams Contingency Contracting Unit Training class to 250 Marines deploying to Helmand Province, Afghanistan. 3. The applicant's OMPF contains a certificate showing he was awarded the Navy and Marine Corps Achievement Medal on 10 December 2013. However, there are no orders in his official record awarding him this medal. 4. The applicant was promoted to lieutenant colonel on 1 May 2014. He is currently a member of the Regular Army. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards), paragraph 1-37a states that peacetime awards of the Army Achievement Medal may be awarded to a servicemember of another military service permanently assigned to an Army unit without the concurrence from the other Service concerned. Likewise, Soldiers permanently assigned to another military service may be awarded other service's decorations (Meritorious Service Medal and below) without seeking concurrence from the Army. A copy of the approved award will be forwarded to the parent service's awards office for permanent record keeping. 2. Secretary of the Navy (SECNAV) Instruction 1650.1H from the Assistant SECNAV (Manpower and Reserve Affairs), dated 22 August 2006, provides guidance and regulations concerning awards available for recognizing individuals and units in the Naval service. It states that other service personnel temporarily assigned to the Department of the Navy (DON) in a non-combat area may not receive DON awards. When a member's service is worthy of special recognition, a recommendation to that effect shall be submitted to the member's parent command for appropriate action. DISCUSSION: 1. The applicant's contention has been noted. The available records show that he was an Army officer and not a member of the U.S. Navy or Marine Corps. According to SECNAV Instruction 1650.1H, other service personnel temporarily assigned to the DON in a non-combat area may not receive DON awards. 2.
