Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests retroactive payment of Board Certification Pay (BCP) for the period 1 January 2012 through 1 October 2015. 2. The applicant states: * he is a board-certified physician on active duty and is entitled to BCP * he has been board certified since 2001 (Internal Medicine) * he recertified in 2011 and submitted his documentation to his personnel office * notice of his recertification did not make it into his official military personnel file (OMPF) or to Defense Finance and Accounting Service (DFAS) * his BCP was terminated in December 2011 * he has documentation from the American Board of Internal Medicine showing there was no lapse in certification * he sent a message to his special pays officer who advised him that they can give him 11 months back pay, but he would need to petition to the Army Review Boards Agency to obtain all of his back pay 3. The applicant provides a copy of his American Board of Internal Medicine Certification. CONSIDERATION OF EVIDENCE: 1. The applicant is a Regular Army Medical Corps colonel. 2. He was promoted to the rank/grade of colonel/O-6 on 15 June 2016. 3. The applicant provides a certification history from the American Board of Internal Medicine. It shows an initial certification from 21 August 2001 through 31 December 2011 and recertification from 6 October 2011 through 31 December 2021. 4. The Office of the Surgeon General (OTSG) provided an advisory opinion, dated 20 July 2017. The OTSG official stated: a. Requests for BCP for physicians are initiated by the officer through their command's supporting Human Resource, Personnel, or S1 office. b. If board certification renewals or maintenance of certification (MOC) are issued, the officer must also submit renewal documentation to ensure BCP continues uninterrupted. c. A review shows the verified missing period of BCP is 1 January 2012 through 30 September 2015. d. The applicant was eligible to receive BCP for the missing 45-month period of 1 January 2012 through 30 September 2015, totaling approximately $18,750 prior to any withholding. The exact payment would be determined by DFAS-Indianapolis (IN) utilizing a Health Professions Pay Entry Date (HPPED) or finance MS-Pay-Date of 15 June 1998 for the correct pay rates. 5. The Case Management Division of the Army Review Boards Agency sent the applicant a copy of the advisory opinion for his information and opportunity to respond. He concurred with the advisory opinion. REFERENCES: Title 37, U.S. Code, Section 302, authorizes BCP for officers in the Medical Corps of the Army designated as active duty medical officers. DISCUSSION: 1. The applicant provided documentation that his Board Certification was uninterrupted between 2001 and the present. 2.
