Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his records to show his home of record (HOR) as Minnesota. 2. The applicant states he was living in a rented house in Wisconsin at the time of his entry into the U.S. Army Reserve Active Guard Reserve (AGR) Program in January 2013 and this address was used in error to establish his HOR. After a discussion with his career manager, he learned the current listing of Wisconsin as his HOR could cause complications for his retirement. Unlike the Regular Army, the AGR Program would require him to move back to Wisconsin. Depending on his final assignment's geographic location, this could actually cost the U.S. Government more to conduct the move. 3. The applicant provides: * memorandum for record, dated 11 October 2016, subject: Request a Change of the HOR for (Applicant) * Minnesota record of homestead application CONSIDERATION OF EVIDENCE: 1. After having prior enlisted active duty service in the U.S. Marine Corps from 7 June 1983 to 6 June 1987 and subsequent enlisted service in the U.S. Marine Corps Reserve and Army National Guard, he was appointed as a second  lieutenant in the Army National Guard on 10 October 2003. He was honorably discharged from the Army National Guard on 31 October 2011 and transferred to the U.S. Army Reserve. 2. U.S. Army Human Resources Command Orders R-12-291203, dated 11 December 2012, ordered him to active duty in an AGR status effective 14 January 2013. These orders show his then-current address and HOR as Tomah, Wisconsin. 3. He was promoted to major effective 1 October 2015. 4. He provided a self-authored memorandum for record, dated 11 October 2016, subject: Request a Change of the HOR for (Applicant), requesting to change his HOR from Wisconsin to Minnesota. He stated: * he purchased a home in Minnesota in August 2007 * a copy of the mortgage was added to his official military personnel file on 4 August 2008 * he has been paying property taxes since the purchase * he was living in a rented house in Tomah, Wisconsin, at the time of his entry into the AGR Program in January 2013 5. His chronological statement of retirement points, dated 17 October 2017, does not show a break in military service. REFERENCES: 1. Army Regulation 601-280 (Army Retention Program) states the term "home of record" means the place (city and state or country) recorded as the home of the individual when commissioned, reinstated, appointed, reappointed, enlisted, reenlisted, inducted, or ordered into the relevant tour of active duty. An HOR can only be changed if there is a break in service of more than 1 day or to correct an error. 2. The Joint Travel Regulations state: a. The HOR for service members is the place recorded as the individual's home when commissioned, appointed, enlisted, inducted, or ordered into a tour of active duty. b. The place recorded as the individual's home when reinstated, reappointed, or reenlisted remains the same as that recorded when commissioned, appointed, enlisted, inducted, or ordered into the tour of active duty unless there is a break in service of more than 1 full day. Only if a break in service exceeds 1 full day may the member change the HOR. c. Travel and transportation allowances are based on the officially corrected recording in those instances when, through a bona fide error, the place originally named at time of current entry into the service was not in fact the actual home. Any such correction must be fully justified and the home, as corrected, must be the member's actual home upon entering the service, and not a different place selected for the member's convenience. d. The home of selection for a uniformed member is the place selected by a member as the member's home upon retirement. DISCUSSION: 1. The applicant requests correction of his records to show Minnesota as his HOR because he was living in a rented house in Wisconsin at the time of his entry into the AGR Program in January 2013 and the Wisconsin address was used in error to establish his HOR. 2. Army Regulation 601-280 clearly states the term "home of record" means the place (city and state or country) recorded as the home of the individual when ordered into the relevant tour of active duty. An HOR can only be changed if there is a break in service of more than 1 day or to correct an error. 3. The Joint Travel Regulations provide that an HOR may only be corrected if a bona fide error can be established. 4. The evidence of record shows he was ordered to active duty in an AGR status from his current location with a reporting date of 14 January 2013. His active duty orders show his address and HOR as Tomah, Wisconsin, at that time. 5. Although he did not incur a break in military service, as a member of a Reserve Component not on active duty following his release from the U.S. Marine Corps on 6 June 1987, he could relocate at any time to any location to meet the needs of his civilian employment unlike Regular Component members. He provided no evidence showing his address and HOR were not Wisconsin at the time he was ordered to active duty in an AGR status in 2013. 6.
