Evidence and Consideration BOARD DATE: 19 December 2017 DOCKET NUMBER: AR20170003326 BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing from his OMPF Permanent Orders 288-27, dated 15 October 2003. __________x_______________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. BOARD DATE: 19 December 2017 DOCKET NUMBER: AR20170003326 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of Permanent Orders 288-27, dated 15 October 2003, from his Official Military Personnel File (OMPF). 2. He states he was previously awarded the AGCM for the correct period of 7 January 1999 to 6 January 2002 while assigned to the Recruiting Command. 3. He provides: * Orders 079-8, dated 20 March 2002 * Orders 288-27, dated 15 October 2003 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 7 January 1999 and he was honorably discharged on 20 October 2004. 2. Permanent Orders 079-8, issued by the U.S. Army Garrison, Fort George G. Meade, Fort Meade, MD, dated 20 March 2002, awarded the applicant the Army Good Conduct Medal (AGCM) (1st Award) for the period 7 January 1999 to 6 January 2002. This order was added to his OMPF on 28 January 2005. 3. Permanent Orders 288-27 issued by Headquarters, 1st Battalion, 87th Infantry, 10th Mountain Division (Light Infantry), Fort Drum, NY, dated 15 October 2003, awarded the applicant the AGCM (1st Award) for the period 6 January 2000 to 6 January 2003. This order was added to his OMPF on 28 January 2005. DISCUSSION: 1. The evidence of record shows the applicant was awarded the AGCM (1st Award) by Permanent Orders 079-8, dated 20 March 2002 for the period 7 January 1999 to 6 January 2002, which is consistent with his period of service. However, this award was not added to his OMPF until 28 January 2005. 2. The evidence further shows Permanent Orders 288-27, dated 15 October 2003, awarded him the AGCM (1st Award) for the period 6 January 2000 to 6 January 2003, which is incorrect since he was previously awarded the AGCM (1st Award) the year prior and he entered the Army on 7 January 1999. In the interest of equity, it appears that it would be appropriate to remove this order from his OMPF. //NOTHING FOLLOWS// ABCMR Record of Proceedings AR20150000953 Enclosure 1 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS ABCMR Record of Proceedings (cont) AR20170003326 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 1 ABCMR Record of Proceedings (cont) AR20170003326 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 2
