The applicant states: a. In accordance with Army Regulation (AR) 601-210 (Regular Army and Reserve Components Enlistment Program), paragraph 2-18(6) "has successfully completed 48 or more classroom semester hours (72 or more quarter hours) (without a 4-year degree) at an accredited degree granting college or university listed in the Accredited Institute of Postsecondary Education (AIPE) (foreign transcripts must be evaluated according to paragraphs 2- 7f and 2- 20), may enlist at any time at pay grade E-3. Applicants with an associate degree will be enlisted at pay grade E- 3 without regard to the number of semester or quarter hours completed." b. His enlistment records incorrectly reflect his education level at the time of enlistment. Although he had provided his recruiting command with a copy of his official transcripts from New Mexico State University, they did not use that as a data verification document for education in section IV, block 30. However, they listed it in section Ill 22a, and they did state in section VI (Remarks) "New Mexico State University Main Campus (Name of school) is listed in the AIPE." Immediately following that statement "Delayed Entry Program (DEP) and Active component pay grade authority: (Effective 1 April 2013) in accordance with AR 601-210, chapter 2-18 a (1) No qualifications for advancement to private (PVT)/E-1." This does not reflect the authorization for enlistment as Private First Class as stated in AR 601-210 stated above. At the time he earned 62 semester hours/78 quarter points/51.00 GPA/Hours. 2. A review of the applicant's official records shows the following: a. On 2 November 2018, the applicant enlisted in the Regular Army DEP in the rank of PVT. b. On 2 January 2019, DD Form 1966 was completed showing the following in: (1) Section 2 (Examination and Entrance Data Processing Codes), item g (Pay Grade) E-1, item h (Date of Grade) 2 January 2019. (2) Section 3 (Other Personal Data), item 22 (Education) April 2014 – October 2016 El Paso Community College and August 2016 – January 2018 New Mexico State University. The applicant was not a graduate of any of the listed colleges. (3) Section 6 (Remarks) shows New Mexico State University Main Campus is listed in the AIPE. DEP and Active Component grade authority in accordance with AR 601-210, chapter 2-18,a, (1) no qualifications for advancement to E-1. c. The applicant's records contain a New Mexico State University transcript showing the applicant transferred/completed 78 credit hours of which he failed or withdrew from 30 semester hours and ended with 33 semester hours at New Mexico State University. New Mexico State University transferred 29 semester hours from El Paso Community College. He had a total of 62 quality points for calculating a grade point average. The applicant was not awarded an Associate Degree from El Paso Community College. (El Paso Community College is listed in the AIPE). d. The applicant remains on active duty. 3. The applicant provides: a. DA Form 3286 (Statement for Enlistment U.S. Army Enlistment Program) showing the requirements to fulfill the applicant's enlistment in the Army. b. ERB showing the applicant's initial entry DOR in the rank of PVT was 2 January 2019. 4. See applicable reference below. BOARD DISCUSSION: After review of the application and all evidence, the Board determined that there is sufficient evidence to grant relief. The applicant earned 48 hours of college credit, thus meeting the requirements for entry into the Army in the rank/grade of PFC/E-3. ? As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by: 1. amending his DD Form 4, dated 2 November 2018, to show his rank/grade as PFC/E-3 2. paying him all back pay and allowances I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ? Paragraph 2-7f states completion of any college course will be accepted for enlistment if the course is clearly identified as a college level course and the college will recognize the credit toward graduation and the degree completion requirements. b. Paragraph 2-17 states persons enlisting in the Regular Army, U.S. Army Reserve or Army National Guard without prior service will be enlisted in the pay grade E-1. The DOR for Regular Army enlistees will be date of enlistment on active duty. The authority for the enlistment grade must be entered in the remarks section of DD Form 1966, to include a statement that the documents used to promote the Soldier have been verified. c. Paragraph 2-18 applies to DEP applicants and states applicants who have successfully completed 48 or more classroom semester hours (72 or more quarter hours) (without a 4-year degree) at an accredited degree granting college or university listed in the AIPE, may enlist at any time at pay grade E–3.
