APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 * Social Security card FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his SSN is incorrectly listed on his DD Form 214 as XXX-XX- XXXX; however his correct SSN is XXX-XX XXXX. He provided a copy of his original Social Security card which shows his correct SSN. 3. A DD Form 4 (Enlistment Record – Armed Forces of the United States) shows the applicant enlisted in the Regula Army on 8 June 1964. This document does not reflect his SSN, but rather his service number. 4. A 2AA Form 630 (Request for Personnel Security Action), dated 30 July 1964, lists the applicant’s SSN as XXX-XX-XXXX. 5. The applicant’s DD Form 214 shows he was honorably released from active duty on 30 March 1967. His SSN is listed as XXX-XX XXXX. 6. The applicant provided a copy of his Social Security card which lists his SSN as XXX-XX-XXXX. BOARD DISCUSSION: After review of the application and all evidence, the Board determined that there is sufficient evidence to grant relief. 1. The record contains sufficient evidence of the SSN, XXX-XX-XXXX, instead of the XXX-XX-XXXX reflected on the applicant’s DD Form 214. 2. The Board also found sufficient evidence to add the Army Good Conduct Medal (AGCM) as the applicant was promoted to SGT/E-5 within two years, indicating honorable service. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending his DD Form 214 effective 30 March 1967 to reflect * the SSN as follows: “XXX-XX-X95X” vice “XXX-XX-X59X,” and * adding the AGCM to item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized). I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers at the time of retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214.
