The applicant did not file within the three-year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant provides supporting documentation for the Army Commendation Medal, PLDC, and the NBC Defense course, which will be added to the applicant's DD Form 214 through an administrative correction. The record of proceedings will address the applicant's request to add MOS 67T and 15T to his DD Form 214. 3. The applicant states the input was either overlooked or not added, but he would like the record to correctly reflect his achievements as a U.S. service member who proudly served. 4. A review of the applicant's available official records only contains a DA Form 2A (Personal Qualification Record), prepared on 11 November 1998 when the applicant was a member of the U.S. Army Reserve, showing the applicant's primary MOS as 92A (Unit Supply Specialist) and secondary MOS as 95B (Military Police). It is void of any additional skill identifiers. The available records do not contain information regarding additional MOSs he may have held prior to his release from active duty on 29 September 1992. 5. See applicable references below. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that partial relief is warranted. 2. The Board concurred with the corrections described in Administrative Note(s) below. 3. The Board found insufficient evidence to conclude the applicant held any additional MOSs during his period of active duty that ended on 29 September 1992. The Board noted that the DD Form 214 should reflect the record as it existed when the form was created, and in the absence of orders or other records confirming he was awarded additional MOSs during his period of active duty, the Board determined there is no error or injustice related to the MOS recorded on his DD Form 214. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by making the corrections described in Administrative Note(s) below. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to any relief in excess of that described above. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-5 (Separation Documents) states DD Form 214, item 14 (Military Education) list formal in service (full-time attendance) training courses successfully completed during the period of service covered by title, length in weeks, and month and year completed; e. g., medical, dental, electronics, supply, administrative, personnel or heavy equipment. Additional skill identifiers will be listed in block 14 and validated. In determining time eligibility for listing of a specialty, 16 days or more will be counted as a month. 3. AR 15-185 (ABCMR) paragraph 2-9 states the ABCMR begins its consideration of each case with the presumption of administrative regularity.
