The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the SSN shown on his DD Form 214 should read . His rank is shown as specialist five (SP5) and should read SGT. His DD Form 214 does not show he completed the Combat Engineer Noncommissioned Officer School at Fort Leonard Wood, MO. 3. On 25 November 1968, he was inducted into the Army of the United States. His DD Form 47 (Record of Induction) shows his SSN as shown on social security card. 4. Item 27 (Military Education) of his DA Form 20 (Enlisted Qualification Record) shows he completed both the Combat Engineer (12B4O) and Pioneer (12A1O) advanced individual training courses in 1969. 5. Headquarters, U.S. Army Personnel Center, Fort Lewis, Special Orders Number 278, 5 October 1970, relieved him from active duty not by reason of physical disability effective 5 October 1970. His rank is shown as SGT. 6. On 5 October 1970, he was honorably released from active duty under the provisions of Army Regulation 635-200 (Personnel Separations – Enlisted Personnel), chapter 5 (Overseas Returnee). His DD Form 214 shows he completed 1 year, 10 months, and 11 days of active service during this period. * item 3 (SSN) shows his SSN as * item 5a (Grade, Rate, or Rank) shows his rank as SP5 * item 25 (Education and Training Completed) shows he completed the following training: * Combat Engineer, 8 weeks, Fort Leonard Wood * Pioneer, 8 weeks, Fort Leonard Wood 7. He provided his social security card, 1 May 2007, showing his SSN as shown on his DD Form 47. 8. A review of the applicant’s service record contains sufficient evidence to support administrative corrections that are not annotated on his DD Form 214 for the period ending 5 October 1970. These omissions will be added to his DD Form 214 as administrative corrections and will not be considered by the Board, to show in item 3 (SSN) and item 5a (Grade, Rate, or Rank). BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was not warranted. The Board carefully considered the applicants request, supporting documents, evidence in the records and regulatory guidance. The Board considered the applicant’s statement, his military service record and documents provided by the applicant. The record shows on the applicant’s DD Form 214 for the period ending 5 October 1970, the annotation for the completed Combat Engineer and Pioneer training. The Board determined there is no action for them to grant relief, what the applicant is requesting is reflected on his DD Form 214 under military education. ADMINISTRATIVE NOTE(S): A review of the applicant’s records shows he is authorized the following administrative corrections not annotated on his DD Form 214 for the period ending 5 October 1970. As a result, amend his DD Form 214 by adding: * item 3 to show his SSN as shown on his DD Form 47 * item 5a to show his rank as SGT REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for the preparation of DD Form 214, including the DA Form 20 and orders. a. The specific instructions for item 3 stated to transcribe the SSN from the individual's DA Form 2189 (Military Pay Voucher). b. The specific instructions for item 5a stated to enter the grade in which serving at time of separation, indicating whether permanent or temporary. c.
