The applicant states her DD Form 214 states she only completed 3 years and 6 months in her primary occupational specialty (MOS). This should be 4 years and 19 days. Additionally, her DD Form 214 shows she had not completed first term of service. She did complete her first term of service; she reenlisted and served an additional 1 year and 19 days before she was honorably discharged. 2. Review of the applicant's service records shows: a. She enlisted in the Regular Army for 3 years and 29 weeks on 1 April 2014. b. She completed basic combat training (BCT) and 16 weeks of advanced individual training (AIT), and she was awarded MOS 35F (Intelligence Analyst) around August or September 2004. c. She was honorably discharged on 7 March 2017 for immediate reenlistment. She immediately reenlisted for 3 years on 8 March 2017. d. On 27 March 2018, she requested separation in accordance with chapter 8 (pregnancy) of Army Regulation 635-200 (Active Duty Enlisted Administrative Separations). e. She was honorably released from active duty on 20 April 2018. Her DD Form 214 shows she completed 4 years and 20 days of active service. It also shows in * Block 11, MOS 35F, Intelligence Analyst, 3 years and 6 months * Block 18, Member has not completed first full term of service 3. By regulation (AR 635-8), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. The information entered thereon reflects the conditions as they existed at the time of separation. a. Block 11, primary specialty, enter the titles of all MOSs awarded and held for at least 1 year during the current period of service and include for each MOS the number of years and months held. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school). b. Block 18, mandatory entry, "Soldier has or has not completed first full term of service." Refer to the enlistment contract (and any extensions) and compare the term of enlistment to the net service in block 12c of the DD Form 214. If Soldier has completed or exceeded the initial enlistment, enter “Has.” If block 12c of the DD Form 214 is less than the Soldier’s commitment, enter “Has Not.” Routinely, a Soldier should not be considered to have completed the first full term of service if separation occurs before the end of the initial contracted period of service. However, if a Soldier reenlists before the completion of that period of service, the first term of service is effectively redefined by virtue of the reenlistment contract. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found partial relief is warranted. 2. For the entry in block 11 of the DD Form 214, time spent training to be qualified in an MOS does not count toward the total time served in the MOS. The Board determined the entry in block 11 of the applicant’s DD Form 214 accurately reflects the amount of time she served in her MOS after completing training and the entry should not be changed. 3. When the applicant reenlisted, she effectively redefined the period of her first enlistment contract and thereby completed her first term of service. The Board determined her DD Form 214 should be corrected to show she had completed her first full term of service. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 as follows: * Delete from block 18 “Member has not completed first full term of service” * Add to block 18 “Member has completed first full term of service” 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to block 11 of the DD Form 214. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214. The specific instructions for block 11 and 18 are as follows: a. Block 11: Primary Specialty. Enter the titles of all MOSs awarded and held for at least 1 year during the current period of service and include for each MOS the number of years and months held. For time determinations, 16 or more days counts as a month. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school). b. Block 18, mandatory entry: “SOLDIER (HAS) OR (HAS NOT) COMPLETED FIRST FULL TERM OF SERVICE.” This information assists the State in determining eligibility for unemployment compensation entitlement. To determine if an enlisted Soldier has completed the first full term of enlistment, refer to the enlistment contract and any extensions to those initial enlistment documents and compare the term of enlistment to the net service in block 12c of the DD Form 214. If Soldier has completed or exceeded the initial enlistment, enter “HAS.” If block 12c of the DD Form 214 is less than the Soldier’s commitment, enter “HAS NOT.” Routinely, a Soldier should not be considered to have completed the first full term of service if separation occurs before the end of the initial contracted period of service.
