The applicant did not file within the 3-year time frame as provided in Title 10, U.S. Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states DD Form 214, item 12a should reflect her date of enlistment into the U.S. Army Reserve (USAR) on 26 August 1982. She further contends DD Form 214, item 12b should reflect her date of separation from the USAR on 2 May 1989. 3. The applicant’s service record is unavailable from the National Archives and Records Administration. The complete facts and circumstances surrounding her military service are unavailable for the Board to review. However, the documents provided by the applicant are sufficient to adjudicate this case. 4. On 26 August 1982, the applicant enlisted in the USAR. 5. On 11 March 1983, the applicant entered active duty for training. On 27 July 1983, she was honorably released from active duty under the provisions of Army Regulation 635-200 (Personnel Separations - Enlisted Personnel) for the completion of active duty training. 6. On 2 May 1989, the applicant was discharged from the USAR under the provisions of Army Regulation 135-178 (Enlisted Administrative Separations) and issued an honorable discharge. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was not warranted. The Board carefully considered the applicants request, supporting documents and evidence in the records. The Board considered the applicant’s statement, her military service record and documents provided by the applicant. The Board determined the evidence presented does not demonstrate the existence of a probable error or injustice. Based on regulatory guidance, the DD Form 214 (Certificate of Release or Discharge from Active Duty) will be prepared for all personnel at the time of their retirement, discharge, or release from Active Army. The Board determined the applicant was properly separated upon completion of her active duty service. Therefore, the Board denied relief. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Document), in effect at the time, prescribed the separation documents which are prepared for individuals upon retirement, discharge, or release from active duty military service or control of the Army. A DD Form 214 (Certificate of Release or Discharge from Active Duty) will be prepared for all personnel at the time of their retirement, discharge, or release from Active Army.
