The applicant states, he is (was) on active duty (at the time he applied) and would retire on 1 November 2020. They put the wrong code on his storage paper saying he only had 3 months of his personal property storage. He is still waiting for his house to be finished; it is still under construction. 2. Review of the applicant's service records shows: a. Having had prior enlisted service, he enlisted in the Regular Army on 27 March 2000. He served through multiple reenlistments in a variety of assignments, and he attained the rank/grade of sergeant first class (SFC)/E-7. b. On 4 May 2020, Joint Base Myer-Henderson Hall, published Orders 042-0001 reassigning him to the Transition Center and retirement processing effective 31 October 2020. c. He retired on 31 October 2020 and he was placed on the retired list in his retired grade of SFC/E-7 on 1 November 2020. 3. On 28 July 20201, the Deputy Chief of Staff, G-4 rendered an advisory opinion in the processing of the applicant's case. The advisor official stated his office reviewed the application and noted the following regulatory provisions in support of a decision. a. The Joint Travel Regulations (JTR) is the basic statutory regulation governing a uniformed member's travel and transportation at government expense, and has the force and effect of law issued primarily under the authority of Title 37 United States ABCMR Record of Proceedings (cont) AR20210005464 Code Section 481. The JTR paragraph 0518 Household Goods Storage states: "When the household goods cannot be withdrawn during the first 90 days due to conditions beyond the Service member's control, a Service member may request a time-limit extension. Additional storage in transit may be authorized or approved due to circumstances beyond the Service member's control such as: awaiting completion of a residence under construction." b. The applicant 7,620 pounds of household goods under Government Bill of Lading BGAC0504840 went into destination storage on 29 April 2020 near Orlando, FL and converted to his expense on 27 August 2020 after 121 days. The government paid $3,005.33 for 121 days of storage in transit. The Soldier requested and received a local delivery out of storage on 1 October 2020. c. The G-4 recommend the Board approve reimbursement for commercial storage fees paid by the Soldier for 34 additional days from 27 August 2020 until 1 October 2020, as it does not exceed a total of 180 days of storage in transit. The Soldier should bring the storage invoice to the closest transportation office (MacDill Air Force Base, Tampa, FL) to process an actual cost reimbursement from DFAS Rome. 4. The applicant was provided with a copy of this advisory opinion to give him an opportunity to submit a response/comments. He did not respond. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. Board members noted that according to the JTR, when HHG cannot be withdrawn during the first 90 days due to conditions beyond the member's control, they may request a time-limit extension. Additional storage in transit may be authorized or approved due to circumstances beyond the member's control such as: awaiting completion of a residence under construction. The applicant's case meet this criteria. Board members agreed with the advisory official's recommendation and voted to grant relief.
