The applicant states that he completed the JQR for his current work role as Target Digital Network Analyst on 1 March 2019. He applied for SDAP and Assignment Incentive Pay (AIP) and on 11 March 2019, he received an email stating that his GEARS work flow was completed; therefore, he assumed that both his SDAP and AIP were effective 1 March 2019. On his May 2019 end of the month leave and earnings statement, he received Save Pay in the amount of $553.33 with a start date of 8 March 2019. He assumed that his initial Save Pay payment covered both his SDAP and AIP back pay to 8 March 2019; however, he was only receiving AIP, not SDAP. He was erroneously informed by his leadership that he was not eligible for SDAP due to being flagged at the time. He requests back pay for SDAP (Special Duty (SD)- 2/$150.00) from 1 March 2019 to 30 March 2020. 2. The applicant's service record shows: a. On 18 November 2015, the applicant enlisted in the Regular Army. b. On 20 October 2016, the applicant reenlisted in the Regular Army for 6 years. DA Form 4789 (Statement of Entitlement to Selective Retention Bonus), dated 20 October 2016, shows the applicant's military occupational specialty as 35N (Signals Intelligence Analyst). 3. The applicant provides: a. Army Cyber Command Memorandum for Record, Subject: CMF Training Certification Policy for Army JQR Validation and Certification, dated 19 July 2019, showing the various proficiency levels and certifying officials. b. 782nd Military Intelligence Battalion Memorandum, Subject: Training and Certification Requirement Verification for FY 20 CAIP for SSG K___, dated 11 February 2020, certifying that SSG K___ completed the training requirement for his work role and qualified for receipt of CAIP. c. 782nd Military Intelligence Battalion Memorandum, Subject: JQR/JQS Verification for applicant, dated 14 April 2020, verifying that the applicant completed his JQR documentation to be certified in his work role and met Army Cyber Command requirement to receive CAIP and SDAP effective 1 March 2019. d. 782nd Military Intelligence Battalion Memorandum, Subject: Training and Certification Requirement Verification for FY 20 CAIP for applicant, dated 14 April 2020, certifying that the applicant completed the training requirement for his work role and qualified for receipt of CAIP. e. DA Form 4187, dated 29 April 2020, showing the applicant requested SDAP for his work role as Target Digital Network Analyst at the Basic level (SD-2) effective 31 March 2020 through the 782nd Military Intelligence Battalion to 780th Military Intelligence Brigade. f. DA Form 2446, dated 29 April 2020, showing the 780th Military Intelligence Brigade requested the applicant's SDAP (SD-2/$150.00) effective 29 April 2020 through 28 April 2021. g. Excerpt from GEARS website, printed on 3 May 2020, showing the applicant's workflow was completed. h. U.S. Army Cyber Command Memorandum, Subject: Approved CAIP for Army Cyber Workforce, dated 13 May 2020, showing that 780th Military Intelligence Brigade's request to authorize CAIP for 12 Soldiers certified, trained, and serving in a designated Cyber Mission Forces work role was approved. The enclosure for Basic or Senior Level Enlisted Certification is not available. 4. In the processing of this case, an advisory opinion was obtained from the Office of the Deputy Chief of Staff, G-1, Deputy Chief, Compensation and Entitlements Division. The advisory official opined their office does not recommend relief of the applicant's request. Soldiers must request AIP and SDAP incentives via DA Form 4187 to the appropriate approving official. Requests for these incentives must demonstrate completion of the defined prerequisites for the assigned work role and agree to a period of service commensurate with the payment of the incentive. The effective date of the incentive will be the date of approval from the approving official. The applicant did not provide evidence of the service agreement associated with the incentive pay prior to his 31 March 2020 request. 5. The advisory opinion was provided to the applicant to afford him the opportunity to respond to its content. He did not respond. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was not warranted. The applicant’s contentions, his record of service, an advisory opinion, and regulatory guidance were carefully considered. The Board determined the applicant did not provide evidence of the service agreement associated with the incentive pay prior to his 31 March 2020 request. The Board concurred with the advisory opinion official finding the effective date of the incentive will be the date of approval from the approving official. Therefore, the Board determined that there was insufficient evidence of an error or injustice to warrant relief in this case. ? REFERENCE: Army Regulation 614-200 (Enlisted Assignments and Utilization Management), Chapter 3-18 (Scope) provides that SDAP is a monetary incentive paid to enlisted Soldiers who qualify for and serve in designated Special Duty assignments that have extremely demanding duties requiring extraordinary effort for satisfactory performance or an unusual degree of responsibility. The Secretary of the Army determines which Special Duties are eligible to receive SDAP and may initiate, terminate, increase, or decrease SDAP for any skill. Orders must be issued to award, change, terminate and reinstate SDAP. a. Enlisted Soldiers are eligible to receive SDAP when they are entitled to basic pay and serving on active duty, are serving in grade of Private First Class or higher, have completed special schooling required for qualification in the SD assignment or have completed equivalent assignment and are certified as qualified for and actually serving in an authorized SD assignment. To continue to receive SDAP, a Soldier must be properly assigned and performing the duties of the designated SD assignment. b. SDAP is in addition to any other pay and allowances to which Soldiers are entitled.
