The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the SSN shown on his DD Form 214 is incorrect. 3. The applicant enlisted in the Regular Army on 12 June 1997. His DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States) and allied documents show he listed the SSN he claims is incorrect on all documents. 4. A review of the applicant's available military records revealed he listed the SSN he claims is incorrect throughout his entire period of active military service. 5. The applicant was released from active duty on 11 June 2000. His DD Form 214 shows the SSN he claims is incorrect. 6. After review of the application and all evidence, the Board majority determined that evidence was insufficient to grant relief. 2. Documentation available for review shows that the applicant signed multiple documents, to include his enlistment document and, as such, attested to the validity and accuracy of those same documents. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed. Based on a preponderance of evidence, the Board determined that the SSN reflected in the applicant's records represented the circumstances at the time of his service and was not in error or unjust. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service.
