The applicant states he is a graduate of USMA at West Point, NY, as it is listed in Block 7a (Place of Entry into Active Duty) on the DD Form 214. He was commissioned on his graduation day on 28 May 1994, listed in Block 12a (Date Entered AD This Period); however, Block 15a is marked “No” and should be changed to reflect “Yes.” 2. The applicant provides a letter from USMA, dated 23 September 2020, signed by the Associate Dean for Academic Affairs and Registrar Services, which states the applicant was in attendance as a cadet of USMA. He entered on 2 July 1990 and graduated on 28 May 1994 with a Bachelor of Science (BS) Degree and a major in Geography Studies (Environmental Science), conferred at graduation. 3. A review of the applicant’s service record shows: a. The service record is void of appointment orders, commissioning documents, and/or transcripts from USMA. b. His Officer Record Brief listed in Section VII (Civilian Education) the USMA Institution with a BS in Environmental Science and a completion date of 1994. c. The DA Form 1059 (Service School Academic Evaluation Report), dated 1 February 1995, noted in Block 16 (Comments): * Commissioning Source – USMA * United States Military Academy Pass 94/12 d. Orders 1XX-000X, dated 8 March 20XX, released the applicant from active duty with an effective date of 31 August 2018. e. He was honorably retired from active duty on 31 August 2018. His DD Form 214 shows he completed 24 years, 3 months, and 3 days of active service. It also shows: * Block 7a. (Place of Entry into Active Duty) – WXXX Xxxx, XX * Block 15a. (Commissioned Through Service Academy) – No 4. By regulation, the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. For Block 15a (Commissioned Through Service Academy), enter “yes” or “no.” BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. Based upon a preponderance of the evidence, the Board determined an error occurred when the contested block was checked “No.” The Board agreed there is sufficient evidence to grant relief.
