The applicant states, in effect, his name and DOB are correctly represented on his DD Form 4 dated 4 April 2000. 2. As a member of the U.S. Army Reserve (USAR), the applicant entered active duty on 4 April 1986. He was honorably released from active duty training on 17 July 1986. Item 1 (NAME, (Last, First, Middle)) of his DD Form 214 lists a contested name. 3. On 16 January 1996, he was honorably discharged. The discharge certificate provided by the applicant lists a contested name. 4. On 9 March 1999, the Superior Court of Guam ordered, adjudged and decreed his name be changed as he requests. 5. On 4 April 2000, the applicant reenlisted into the USAR. His DD Form 4 lists the name he now requests. Effective 21 March 2003, he was voluntarily released from the USAR Control Group (Reinforcement). Orders C-03-308832 dated 23 March 2003, lists the name as he requests. 6. The applicant provides several documents to include a driver's license and social security card which list his name as he requests. 7. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined partial relief was warranted. Based upon the available documentation, the Board found that the name change occurred post-service; therefore, there was insufficient evidence of an error or injustice which would warrant a change to the applicant’s DD Form 214. However, based upon the information reflected on the applicant’s DD Form 4, dated 4 April 2000, the Board concluded that the DOB reflected on the applicant’s DD Form 214 was entered in error and warranted correction. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by changing his date of birth to the DOB reflected on the applicant’s DD Form 4, dated 4 April 2000. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to changing the name reflected on the applicant’s DD Form 214.
