APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Orders Number 225-0610 and 035-0200 FACTS: 1. The applicant states he did not receive a CSB and his retirement pay is currently reflecting that he did. His retirement orders have been corrected to reflect this. He feels a clerical error should not prevent him from receiving the retired pay he was promised. 2. The applicant provides: * Orders Number 225-0610, dated 13 August 2018, directing his retirement effective 1 August 2019 * Order Number 035-0200, published by Headquarters, 101st Airborne Division (Air Assault), Fort Campbell, KY on 4 February 2021, amending Orders Number 225-0610, by adding the entry: "CSB: Soldier is Eligible And Has Not Elected to Participate" 3. Review of the applicant’s service records show: a. He enlisted in the Regular Army on 18 June 1998 and he held military occupational specialty 91Z Mechanical Maintenance). He served continuously on active duty in various assignments and through several reenlistments. b. On 6 August 2019, he executed and signed a DA Form 2339 (Application for Voluntary Retirement), with a desired retirement date of 1 August 2019. c. Orders Number 225-0610, published by Headquarters, 101st Airborne Division (Air Assault), Fort Campbell, KY on 13 August 2018, announced his placement on the Retired List on 1 August 2019. The orders contain the entry: "CSB: Soldier is Eligible And Has Elected to Participate" d. He was honorably retired, in pay grade E-8, on 31 July 2019. His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows he completed 21 years, 1 month, and 13 days of net active service. e. Order Number 035-0200, published by Headquarters, 101st Airborne Division (Air Assault), Fort Campbell, KY on 4 February 2021, amended Orders Number 225-0610, by adding the entry: "CSB: Soldier is Eligible And Has Not Elected to Participate." 4. By regulation (AR 600-8-104), depending on the purpose, documents will be filed in the OMPF in one (or more) of eleven (11) sections: performance, service, restricted, medical, flight, finance, State/Territory, deployment/ mobilization, administrative, personnel records review, and/or medical records review. Once placed in the OMPF, the document becomes a permanent part of that file. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. Board members noted that the applicant's initial retirement orders, dated 13 August 2018, announced his placement on the Retired List on 1 August 2019 and contained the entry: "CSB: Soldier is Eligible And Has Elected to Participate." However, on 4 February 2021, the same Headquarters published amendments orders by adding the entry: "CSB: Soldier is Eligible And Has Not Elected to Participate." These amendment orders are not filed in his official record. Board members determined they should be. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by filing Order Number 035- 0200, published by Headquarters, 101st Airborne Division (Air Assault), Fort Campbell, KY on 4 February 2021, into the applicant's Army Military Human Resource Record.
