The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not reflect that he served in Kuwait from 20160629 - 20170224. He would like for this information to be corrected and an updated copy of his DD Form 214 sent to him (sic). 3. The applicant provides: * Orders BL-117-0421, dated 26 April 2016, which shows he was deployed in support of Operation Enduring Freedom (Spartan Shield) Kuwait; will proceed on or about 31 May 2016 * ERB, dated 26 October 2020, which shows in Section I- Assignment Information, (OS/Deployment Combat Duty) 20160629-20170224 Kuwait (KU) 4. Review of the applicant’s service record shows: a. He enlisted in the Regular Army (RA) on 29 May 2012. b. His DA Form 2166-9-1 (NCO Evaluation Report (SGT)), in Part I – Administrative Data, Block J (Period Covered) 20160401 – 20170331, shows he served in Kuwait as a Team Leader supporting Operation Spartan Shield (OSS 16-17). c. He was discharged from active duty on 23 October 2020. His DD Form 214 shows an honorable character of service. He completed 7 years, 11 months, and 25 days of net active service this period. Block 12f (Foreign Service) shows 2 years Foreign Service. Block 18 (Remarks) reflects Foreign Service duty assignment overseas in Kuwait (20130711-20131028; 20150225-20151024). 5. By regulations: a. AR 614-30 (Overseas Service), the Overseas Service Ribbon may be awarded if a Soldier serves 9 months in a continuous Temporary Change of Station/Temporary Duty status in areas where the unaccompanied tour length is up to 18 months, or in isolated areas, such as Iraq, where tour lengths have not been established by the Department of Defense. b. Army Regulation (AR) 635-5 (Separation Documents) DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty), will be issued to provide missing information or to correct any information. Block 18 (Remarks) will be utilized to address incomplete item and state “DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) will be issued to provide missing information.” DD Form 215 will be issued when the missing information becomes available. Block 12f enter the total amount of Foreign Service completed during the period covered in block 12c. Obtain the foreign service listed in Sec 1, DA Form 4037 (ORB) for officers or Sec 1 (ERB) for enlisted soldiers to compute this entry. if necessary, verify the Foreign Service in the MPRJ. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. Based upon the reflected on the applicant’s ERB and the information reflected on the applicant’s DD Form 214, the Board concluded there was information on the applicant’s DD Form 214 missing concerning his third deployment to Kuwait. Therefore, they recommended granting the applicant’s requested relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by adding to Item 18 (REMARKS), “SERVICE IN KUWAIT 20160629- 20170224”. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-8 (Personnel Separations - Separation Processing and Documents) DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty), will be issued to provide missing information or to correct any information. Block 18 (Remarks) will be utilized to address incomplete item and state “DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) will be issued to provide missing information.” DD Form 215 will be issued when the missing information becomes available. AR 614-30 (Overseas Service), paragraph 3-3 states the prescribed outside the continental United States tour lengths for long and short tour areas are listed in the Joint Federal Travel Regulation, Appendix Q, Table 1.
