The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states her civilian service history found in her Electronic Official Personnel Folder (eOPF), shows her return to civilian duty was on 1 January 2012. However, her DD Form 214 and estimated earnings show military service through 22 January 2012, which overlaps her civilian service. In order to submit an application for a military service deposit (MSD), her DD Form 214 and estimated earnings must be changed to accurately reflect the end of military service as 31 December 2011 immediately prior to the start of the civilian service period on 1 January 2012. 3. She enlisted in the U. S. Army Reserve (USAR) on 2 July 1982. b. She entered active duty on 31 July 2010. c. On 22 January 2012, her DD Form 214 shows she was Release from Active Duty in accordance with chapter 4 of Army Regulation 635-200 (Personnel Separation – Active Duty Enlisted Administrative Separations), with an honorable character of service. It also shows she completed 1 year, 5 months, and 22 days of net active service this period. d. Orders 12-352-00019, dated 17 December 2012 shows she was assigned to the Retired Reserve with an effective date of 16 January 2013. 5. By regulation AR 635-5 (Personnel Separations – Separation Documents), the DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The applicant’s active service was continuous and his DD Form 214 already lists the period of continuous honorable service. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. The Board considered the applicant's statement, her DFAS Leave and Earning Statements, the information on the DD 214 and the dates on the orders transferring her to the Retired Reserve. The Board found insufficient evidence to show that the service reflected on those documents was not an accurate representation of her service. Based on a preponderance of the Board determined that the end date of the applicant’s DD Form 214 was not in error or unjust. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-8 (Personnel Separations -Separation Processing and Documents) DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty), will be issued to provide missing information or to correct any information.
