Evidence of record shows that the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct-pattern of misconduct, with an under other than honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, waived consideration of his case by an administrative separation board contingent upon him receiving a characterization or description of service no less favorable than a general, under honorable conditions, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service. The unit commander and intermediate commanders recommended disapproval of applicant’s request for conditional waiver. On 24 January 2001, applicant again consulted legal counsel, and waived a hearing by a board of officers, and did not submit a statement in his own behalf. On 6 February 2001, the separation authority directed that the applicant be discharged with a characterization of service of an under other than honorable conditions. b. On 9 February 2001, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 7 months, and 11 days of active military service in the period under review. 2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted. Propriety: The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge. b. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board noted the applicant’s contentions, however, the Board found sufficient misconduct and substandard performance in his official record to warrant the separation action under review. The applicant's discharge was appropriate because the quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The record shows that the applicant received a two Article 15s for failing to go to his appointed place of duty, disobeying a lawful order, assaulting a sergeant, and assaulting a private. He was also counseled on numerous occasions for disrespect, failing to repair, poor performance of duty, disobeying his chain of command, and for refusing to train. The applicant provided no independent corroborating evidence demonstrating that either the command’s action was erroneous or that the applicant’s service mitigated the misconduct. Before initiating action to separate the applicant, the command ensured the applicant was appropriately counseled about the deficiencies that could lead to separation. The Board noted that the command made an assessment thereafter of the applicant's potential for becoming a fully satisfactory soldier, and the command appropriately determined the applicant did not demonstrate the potential for further military service. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief. 3.
