After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. Although your application was not filed in a timely manner, the Board found it in the interest of justice to waive the statute of limitations and consider your application on its merits. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. You enlisted in the Navy and began a period of active duty on On you completed a course of instruction on the code of conduct and uniformed code of military justice (UCMJ) for members of the Armed Forces. On you were convicted in civil court for reckless driving, hit and run-property damage, and no operators permit. On you received non-judicial punishment (NJP) for conduct prejudicial to the good order and disciple of the armed forces by joy-riding in a vehicle not your own. On , you received NJP for being absent from your appointed place of duty, and dereliction of duty. On you were notified that you were not recommended for reenlistment due to low average of evaluation marks in military behavior. On you were released from active duty under honorable conditions. The Board carefully weighed all potentially mitigating factors, such as your desire to upgrade your discharge and for your DD 214 to include all medals listed and awards. The Board noted that characterization of service is often based on the overall trait average (OTA), computed from marks assigned on a periodic basis. The Board determined you were assigned the appropriate characterization of service, and discerned no impropriety or inequity in the discharge. In regard to your request for awards, your request does not fall under the purview of this Board. As a courtesy, you request for awards is being forwarded to the Navy Department Board of Decorations and Medals (NDBDM), 720 Kennon Street SE, Suite 309, Washington Navy Yard, DC 20374, for adjudication.
