Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (I) with this Board requesting, in effect, that the applicable naval record be corrected to reflect that Petitioner's awards points on Final Multiple Score for Exam Data Cycle 097 (Aug 15) reflect 3 points vice 2 points and that Petitioner's Final Multiple Score be recalculated for the August 2015 (Cycle 097) Navy Wide Advancement Examinations (NWAE) for advancement in rate of Selected Reserve (SELRES) personnel. 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on March 8, 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of the Petitioner's naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. c. Petitioner's Exam Profile Data for Exam Data for Cycle 097 (August 2015) reflected his Awards point in Final Multiple Score as (2), with a Final Multiple Score of 104.70 and a required minimum FMS of 105.35. d. Petitioner earned the Letter of Commendation Flag Officer (LOC FLAG) for the inclusive period of April 29, 2012 through May 12, 2012. e. Petitioner earned Navy and Marine Corps Achievement Medal (NAM) for the inclusive period of June l,2012 through April 13,2014. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an administrative error warranting the following corrective action. The Board concluded that the Petitioner was awarded and earned the LOC Flag and NAM prior to the day of the regularly scheduled August 2015 (Cycle 097) NWAE. The Board finds the existence of an injustice warranting the following corrective action. Petitioner's Final Multiple Score for the August 2015 (Cycle 097) did exceed the required minimum of 105.35. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The Petitioner's Examination Profile Information and Exam Status sheet from the August 2015 Cycle 097 NW AE is modified to read "3" awards points. The FMS (Final Multiple Score) is "105.70" vice "104.70". Note: Minimum Multiple Required score was 105.35. The Petitioner was advance to ES effective June 16, 2016 with a Time in Rate of January 1, 2016. Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner's records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
