The Board, consisting of reviewed Petitioner's allegations of error and injustice on 22 February 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner's naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy.· b. In accordance with reference (b ), a member who acquires a spouse must make RCSBP election within I-year of the marriage. c. Petitioner married on 31 December 1964. d. Petitioner transferred to the Retired Reserve without-pay effective I March 1998. Prior to retirement Petitioner elected Spouse RCSBP coverage. e. Petitioner divorced on 4 December 1998. Subsequent to his divorce, Petitioner's RCSBP coverage was suspended the effective date of divorce. f. Petitioner transferred to the Retired Reserve with-pay on ; his 60th birthday. g. Petitioner married CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. Petitioner failed to submit DD Form 2656­6, Survivor Benefit Change Certificate within I-year of his marriage. Although the proper administrative requirements were not completed by Petitioner in a timely manner, the Board concluded that a measure of relief is warranted. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: . Petitioner named as the beneficiary, at the same level of coverage as previously Note: Petitioner is responsible for unpaid SBP costs. No waiver of unpaid premiums will be granted. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4. 1t is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter. 5.
