Pursuant to the provisions ofreference (a), Petitioner, an enlisted member of the Marine Corps, filed enclosure (1) with this Board requesting that his record be corrected by removing his fitness report (FITREP) for the reporting period 1 July 2016 to 12 July 2017, enclosure (2), from his official military personnel file (OMPF). 2. The Board, consisting of , reviewed Petitioner'sallegations of error and injustice on 15 January 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of Petitioner's application, together with all material submitted in support thereof, relevant portions of the naval records, and applicable statutes, regulations and policies. Additionally, the Board considered the advisory opinion (AO) provided at enclosure (3). 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner was issued an adverse FITREP for the reporting period from I July 2016 to 12 July 2017. Petitioner contends that he was not properly informed by his command about a new Physical Fitness Test (PFT) policy, which resulted in his failure of the PFT on 28 June 2017. The contested report was marked adverse due to his PFT failure, and his Reviewing Officer's (RO) commented that Petitioner did not thoroughly understand the new PFT process for re-taking the PFT in order to obtain a higher score. In support of his contention, Petitioner submitted a letter from his command to show he passed a formal command-scheduled PFT on 30 June 2017. c. In correspondence attached as enclosure (3), the office having cognizance over Petitioner's request to remove the FITREP concluded that the report is procedurally correct as written and filed, because, in accordance with reference (b ), failing an annual training event such as the PFT constitutes a "performance related adversity." Furthermore, the AO noted that, in his rebuttal to the FITREP, Petitioner accepted responsibility for failing the PFT, stating that he was "not here to give any explanations for [his] actions." CONCLUSION Upon review and consideration of all the evidence of record, the Board concluded that Petitioner's request warrants partial favorable action. The Board substantially concurred with the comments and recommendation in the AO. However, the Board concluded that Petitioner's Reporting Senior (RS) and RO may add an addendum page to the contested FITREP. RECOMMENDATION In view of the above, the Board recommends the following corrective action. Petitioner's naval record be corrected by authorizing his RS and RO to add an addendum page to the contested report. No further relief be granted. 4. Pursuant to Section 6(c) of the revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(c)), it is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above-entitled matter. 5.
