Pursuant to the provisions ofreference (a), Petitioner, the son ofa former , filed 5 U.S.C. 552(b)(6) enclosure ( 1) with this Board requesting that his father's Report ofSeparation from the Armed Forces of the United States (DD Form 214) be corrected to reflect the National Defense Service Medal. Enclosures (I) and (2) apply. 2. The Board, consisting of , reviewed Petitioner's , and 5 U.S.C. 552(b)(6)5 U.S.C. 552(b)(6) allegations oferror and injustice on 17 April 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitioner's naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest ofjustice to waive the statute of limitations and review the application on its merits. c. The National Defense Service Medal was authorized for the War, June to 27 July 1954. Petitioner served in the Navy from October to September . CONCLUSION: Upon review and consideration of all the evidence ofrecord, the Board concludes that Petitioner's request warrants favorable action. Subj: REVIEW AVAL RECORD OF FORMER 5 U.S.C. 552(b)(6) , US , 5 U.S.C. 552(b)(6) The Board concludes Petitioner is entitled to the National Defense Service Medal for the time he served during the Korean War. RECOMMENDATION : In view of the foregoing, the Board finds the existence of an error warranting the following corrective action. Petitioner be issued a DD Form 215, Correction to DD Form 214 indicating the issuance of the National Defense Service Medal. A copy of this report ofproceedings be filed in Petitioner's naval record. Upon request, the Department ofVeterans Affairs be informed that Petitioner's application was received by the Board on 27 February 2018. 4.
