Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to reflect that Basic Allowance for Housing (BAH) at the single rate was authorized upon joining present command effective January 15, 2018. 2. The Board, consisting of reviewed Petitioner's allegations oferror and injustice on March 15, 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitioner's naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request does not have merit and warrants an unfavorable action. c. On January 15, 2018, the petitioner is joined by Submarine Development for duty and petitioner's BAH at the single rate terminates effective January 14, 2018. See enclosures (3) and (4). d. Petitioner's BAH adjustment from the single rate of $l,433.70 to the partial rate of$8.70 effective January 14, 2018 created a debt of-$751.46. See enclosure (5). e. On February 20, 2018 Petitioner initiates command single BAH request which is approved February 21 , 2018. See enclosure (6). CONCLUSION Upon review and consideration of all the evidence ofrecord, and disagreed with the contents of enclosure (2), the Board finds the existence ofan injustice warranting the following corrective action. The Board concluded that the Petitioner was never assigned unaccompanied government quarters at his parent command and incurred housing cost without reimbursement effective January 15, 2018. The Board also concluded per the regulations the commander responsible for the Government quarters has the authority to assign and terminate the assignment. A Service member is still considered assigned to Government quarters when he or she voluntarily vacates assigned quarters without the installation commander's approval. Since the Service member was never assigned Government quarters as required the Board concluded the Petitioner is entitled to a credit ofBAH at the single rate for the period ofJanuary 15, 2018 through February 20, 2018. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: Petitioner's request for single rate BAH at the zip code of , was initiated and approved effective January 15, 2018. A credit will be applied to the Petitioner's Master Military Pay Account reflecting BAH single rate, zip code from January 15, 2018 through February 20, 2018. Note: Defense Finance & Accounting Service (DFAS) will complete an audit ofPetitioner's records to determine ifPetitioner is due any back pay and allowances. A copy of this Report ofProceedings will be filed in Petitioner's naval record. 4. Pursuant to Section 6(c) ofthe revised Procedures ofthe Board for Correction ofNaval Records (32 Code ofFederal Regulations, Section 723.6(c)) it is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5.
