Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to receive Basic Allowance for Housing (BAH) at the old permanent duty station (PDS) rate. 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 15 June 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitioner's naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 9 March 2017, Petitioner submitted a close proximity move request to his gaining activity, . c. Petitioner also submitted a close proximity move request to his detaching activity, on 14 March 2017. The request was approved on 26 March 2017. d. On 30 March 2017, sends a letter to regarding the Petitioner's close proximity move request approval. e. On 12 April 2017, send the a letter to remove the funding for household goods (HHG) from the Petitioners official change duty orders and re-issue the orders. f. On 18 April 2017, the Administrative Leading Petty Officer emailed the Petitioner' s close proximity move request approval to the . g. Petitioner received BUPERS Order , Official Change Duty Orders on or about 21 August 2017. h. Petitioner detached on 27 November 2017. i. Petitioner reported to on 11 December 2017 without modified change duty orders to remove the HHG funding line of accounting. j . On 15 June 20 18, Naval Supply Systems Command verified that the Petitioner has not completed a HHG move since 2012. CONCLUSION Upon review and consideration ofall the evidence of record, the Board finds the existence ofan injustice warranting the following corrective action. The Board concluded that the Petitioner provided sufficient evidence ofcompleting his close proximity move request per reference (b). However, the detailer failed to remove the HHG funding line ofaccounting and modify the Official Change Duty Orders accordingly. The Board felt that under these circumstances, a measure of relief is warranted. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: Petitioner's BUPERS order dated 21 August 2017 was modified when his close proximity move request was approved prior to his transfer 27 November 2017. Petitioner was authorized BAH at the with-dependent rate for , from 11 December 2017 to 19 March 20 18. Note: In order to continue to qualify for BAH based on the previous Permanent Duty Station (PDS), the following provisions must be met: funding for a Household Goods (HHG) move must not be authorized, the member must maintain a continuous residence, and the member must commute daily to the new PDS from the same residence. A copy ofthis Report of Proceedings will be filed in Petitioner's naval record. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf ofthe Secretary of the Navy.
