Pursuant to the provisions of reference (a), Petitioner, a Navy petty officer, filed enclosure (1) with the Board for Correction of Naval Records (Board) requesting that his cycle Physical Readiness Information Management System (PRIMS) record be corrected to reflect a medical waiver for the Physical Readiness Test (PRT). 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In enclosure (1), Petitioner contends incorrect scores were input by the assistant command fitness leader. He did not participate in the PRT because he was medically waived for cycle Further, Petitioner’s command has attempted to correct his record numerous time, but due to turnover of personnel, the letter of correction was delayed and not submitted to PRIMS in a timely manner. c. In support of his petition, Petitioner submitted enclosure (2), a Physical Fitness Assessment Medical Clearance/Waiver. d. On the Commanding Officer, submitted enclosures (3) through (5), letters to the Director, Physical Readiness and Community Support (N170B) requesting the correction of Petitioner’s cycle PRIMS record reflecting a medical waiver for cardio, curl-ups and push-ups. The correspondence explained that the PRT data entered via an excel document was inaccurate and due to a medical waiver, Petitioner did not participate in the PRT portion of the PFA. CONCLUSION: Upon review and consideration of all the evidence of record, the Board found the existence of an injustice warranting corrective action. The Board noted that Petitioner’s Commanding Officer clearly explained the reason Petitioner’s score was not correctly recorded at the time of the PFA. The Board noted that in accordance with reference (b), the Navy Physical Readiness Program, “the CO has authority over…medical waivers for the PFA” and “the Service member’s CO has the final authority for granting all PFA medical waivers.” The Board found Petitioners evidence provided in enclosures (2) through (5) credible and sufficient to determine that the Commanding Officer approved Petitioner’s medical waiver. As such, the Board concluded, Petitioner was medically waived from participating in the PRT; therefore, his PRIMS record shall be corrected to reflect “medically waived” for the PRT portion of the cycle Physical Fitness Assessment. RECOMMENDATION: In view of the above, the Board directs the following corrective action. Petitioner’s naval record be corrected by updating the cycle record to reflect “medically waived” for the PRT portion of the Physical Fitness Assessment. Any material or entries inconsistent with or relating to the Board’s recommendation be corrected, removed or completely expunged from Petitioner’s record, that no such entries or material be added to the record in the future. This includes but is not limited to all information systems/data base entries which reference and/or discuss the material being expunged. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
