Pursuant to the provisions ofreference (a), Petitioner, an enlisted Marine, filed enclosure (1) with this Board requesting his naval record be corrected by removing an Administrative Remarks (Page 11) 6105 counseling entry from his official military personnel file (OMPF). 2. The Board, consisting of , , and reviewed Petitioner's allegations of error and injustice on 9 May 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner's naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 5 January 2015, Petitioner was counseled concerning a physical condition (fracture of phalanges offinger) which interfered with his duties. Specifically, the inability to participate in rigorous exercises, conditioning hikes, and field duty. See enclosure (2). c. Petitioner contended the Page 11 specifies his deficiency with corrective action that is not in violation of any Article of the Uniform Code of Military Justice. Furthermore, it does not outline a lack of maturity, judgement or bringing discredit upon our Armed Forces. CONCLUSION Upon review and consideration of all the evidence of record, the Board concluded that Petitioner's request warrants favorable action. In this regard, the Board determined that the contested Page 11 contains medical information, and the Page 11 is not an appropriate place to discuss a treatment plan for a medical condition. Further, there is no indication that Petitioner committed any misconduct. RECOMMENDATION In view of the above, the Board directs the following corrective action. Petitioner's naval record be corrected by removing the contested Page 11 entry at enclosure (2) from his OMPF. Any material or entries inconsistent with or relating to the Board's recommendation be corrected, removed or completely expunged from Petitioner's record, that no such entries or material be added to the record in the future. This includes but is not limited to all information systems/data base entries which reference and/or discuss the material being expunged. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter.
