After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found that the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. Although your application was not filed in a timely manner, the Board found it in the interest of justice to waive the statute of limitations and consider your application on its merits. A three- member panel of the Board, sitting in executive session, considered your application on 21 October 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record, and applicable statutes, regulations, and policies. Your record is incomplete, in that it does not contain your Certificate of Release or Discharge from Active Duty (DD Form 214) covering your first period of service with the Marine Corps. However, your record does contain a Certification of Military Service that shows you were an active duty member of the Marine Corps from 17 December 1986, until you were honorably discharged on 11 May 1990. On 12 May 1990, you reenlisted in the Marine Corps and based on your DD Form 214, served until 12 May 1994, when you were honorably released from active duty and transferred to the Marine Corps Reserve. The Board carefully weighed all potentially mitigating factors, such as your record of service, and desire to have your date of entry into the Marine Corps changed from 900512 to 861217 on your DD Form 214 ending 940512. The Board found that your DD Form 214 ending 12 May 1994, includes all of your prior active duty service in block 12d. If you still believe your dates of service are incorrect, you may submit your request to Headquarters, United States Marine Corps, (Code MMER), 3280 Russell Road, Quantico, VA 22134-5103, to request that an administrative correction on your DD 214 or an additional DD Form 214 covering your period of service ending 11 May 1990. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon the submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
