Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was not charged leave while assinged to Officer Programs Recruiting, Operations Department while on Officer Hometown Area Recruiting Program (OHARP). 2. The Board, consisting of, reviewed Petitioner’s allegations of error and injustice on 24 November 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 8 June 2017, Petitioner enlisted for 8 years under the Navy Officer Candidate Civil Engineer Corps (CEC) Officer (5100) Program. c. 20 September 2018, Petitioner was discharged in order to accept commission or warrant in same branch of service. d. On 21 September 2018, Petitioner was commissioned as an Ensign in the active U.S. Navy with a designator code of 5100. e. From 21 September 2018 to 21 September 2018, Petitioner was attached to for temporary duty. f. On 17 October 2018, , notified that during the period of 26 September 2018 to 18 October 2018, Petitioner was assinged to Officer Programs Recruiting, Operations Department while on OHARP. Note: Petitioner’s orders were endorsed for the period of 24 September 2018 to 18 October 2018. g. From 19 October 2018 to 16 January 2019, Petitioner was attached to FEAD, for temporary duty. h. On 9 November 2018, Petitioner was charged with delay en route/training travel from 21 September 2018 to 17 October 2018 (27 days). i. From 26 January 2019 to 10 May 2019, Petitioner was attached to for temporary duty. j. On 20 May 2019, Petitioner arrived to FEAD, for duty. k. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that an error exists. Petitioner was erroneously charged leave while assinged to Officer Programs Recruiting, Operations Department while on OHARP. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was issued official orders modification to read: In carrying out above orders member is authorized to report to Navy Recruiting District, for temporary duty assigned to Officer Programs Recruiting, Operations Department while on Officer Hometown Area Recruiting Program (OHARP) on 20 September 2018. Note: Petitioner is advised to resubmit his travel claim, orders, receipts, and a copy of this Board of Correction of Naval Records (BCNR) decision letter to his servicing Personnel Support Detachment for re-adjudication. Settlement of travel claim is chargeable to the line of accounting on the Petitioner’s BUPERS order if applicable. Petitioner’s leave will be restored. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
