Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to retroactive Physicians Board Certification Pay (BCP). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 30 August 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of the Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action: Petitioner obtained the Board Certification for Internal Medicine on 12 August 2015. Petitioner was informed by the American Board of Internal Medicine of certification approval on 8 October 2015, and Petitioner submitted request for BCP entitlement on 14 October 2015. Petitioner was provided BCP on 8 October 2015, but Petitioner’s BCP was not retroactively paid for the period of 12 August 2015 to 7 October 2015. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The Petitioner submitted a BCP request in a timely manner, in accordance with OPNAVINST 7220.17. Furthermore, the request was received and approved by cognizant authority. This change will entitle Petitioner to a BCP incentive, at the annual rate of $2,500 for period 12 August 2015 to 7 October 2015. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. In accordance with reference (a), the Board for Correction of Naval Records has reviewed allegations of error and injustice in the naval record of the Petitioner. 2. The Regulations approved by the Secretary of the Navy require that the naval record of Petitioner to be corrected, where appropriate, in accordance with the approved recommendation of the Board as contained in enclosure (1). 3. By copy of this letter, the Defense Finance & Accounting Service, DFAS-IN/COR/Claims, is authorized to pay all monies lawfully found to be due as a result of the above correction to Petitioner’s naval record. 4. The Board has advised Petitioner of the approved recommendation. 5. Navy Personnel Command (NPC), Records Analysis Branch (PERS-312), will make corrections to your record where appropriate. Please do not contact NPC until at least 60 days from the receipt of this letter at the NPC Customer Relations Management (PERS-1) at 1-866-827-5672. After NPC makes these changes, the Defense Finance and Accounting Service (DFAS) will make payment of any money that you may be entitled.
