Pursuant to the provisions of reference (a) Petitioner, a commissioned officer in the Navy, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected by back dating effective date of advancement to the previous exam cycle. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on July 19, 2019 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants partial favorable action. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting partial relief. In this regard, the Board concurred with the Advisory Opinion at enclosure (2). Specifically, the Board determined that the Petitioner did not obtain the required Final Multiple Score of 102.21 for advancement. The Board did agreed that the Petitioner was not provided the appropriate exam for the March 2018 (Cycle 239). The Board concluded that per reference (b) the Petitioner was authorized to compare and grade the March 2018 (Cycle 239) with his September 2018 (Cycle 240) exam. RECOMMENDATION In view of the above, the Board directs the following corrective action. Petitioner’s naval record be corrected to reflect, Petitioner administered the March 2018 cycle 239 Navy Wide Exam (NWAE). Petitioner’s Final Multiple Score (FMS) for this exam was 96.60, which did not exceed the minimum FMS required of 102.21. Note: This change will authorize the applicable passed not advanced (PNA) points earned from this exam to be added to further advancement exams. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
