Pursuant to the provisions of reference (a), Petitioner, a Chief Petty Officer in the Navy, filed enclosure (1) with this Board requesting, in effect, to (1) request Basic Allowance for Housing (BAH) due to close proximity move be authorized. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on July 12, 2019 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On December 1, 2015, Petitioner is joined for duty with c. On November 1, 2016, Petitioner’s first mortgage payment for residence property located in . d. On December 22, 2017, Petitioner is married to dependent spouse. BAH at the married rate for the Permanent Duty Station e. On April 2, 2018, Petitioner issued BUPERS order 0928 for detachment during October 2018 with two intermediate activities in route to report to Estimated date of arrival (EDA) December 13, 2018. f. On August 18, 2018, Petitioner submits Close Proximity Move request to PERS 451H via the gaining command. Application endorsed favorably by the Commanding Officer and forwarded to PERS 451H on September 11, 2018. g. On September 28, 2018, Petitioner’s BUPERS order 0928 is modified, however, the accounting data for Household goods move (HHG) and dependent transportation was not removed. h. On October 2, 2018, Petitioner detaches from parent command i. On December 13, 2018, Petitioner is joined for duty by and BAH is changed to the j. The Petitioner contends that upon receiving BUPERS order 0928 that he requested close proximity move authority which was granted by the gaining command’s Commanding Officer. He asserts this application was forwarded to PERS-451 and his Detailer had informed him the BAH rate would not be changed from Petitioner noted that due to new home construction in the area his house number was and that the residence actual location had not changed. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting partial relief. In this regard, the Board agreed that the Petitioner had followed all requirements to apply and approved for close proximity move authority. The Board also agreed that though the Petitioner’s house number changed from “the evidence showed actual residence location has remained the same throughout. The Board concluded that the Petitioner has not changed residences since November 1, 2015 and that the Basic Allowance for Housing at the remain effective. RECOMMENDATION In view of the above, the Board directs the following corrective action. The Petitioner’s close proximity move was approved effective September 11, 2018. The Petitioner maintained Basic Allowance for Housing at the married rate for the upon reporting to on December 13, 2018. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
