Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to have Home of Record corrected from to . 2. The Board reviewed Petitioner’s allegations of error and injustice on July 16, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On , Petitioner was born in . See enclosure (2). c. In June of 1990, Petitioner completed high school in . See enclosure (2). d. On May 11, 1991, Petitioner married Navy service member in . See enclosure (3). e. On March 3, 1993, Petitioner enlisted in U.S. Naval Reserve for 8 years for enlistment in the Regular component of U.S. Navy for not less than 4 years. On April 21, 1993 Petitioner enters active duty service. See enclosure (4). g. On May 9, 1995 Petitioner discharged from Naval Service. Block 7.a. Place of Entry into Active Duty, . Block 7.b. Home of Record, . See enclosure (5). h. Petitioner contends she was born, raised, and married in . While living in with active duty husband she enlisted in the U.S. Naval Reserve. She asserts that when asked by the Navy Recruiter what location was her Home of Record she indicated and assumed it was reflected on her record. i. In correspondence attached as enclosure (6), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that there is no evidence in the documents provided to indicate the current Home of Record is incorrect. j. Petitioner provides rebuttal statement concerning enclosure (6). See enclosure (7). CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosures, the Board finds the existence of an injustice warranting the following corrective action: The Board determined sufficient information was provided to conclude it would be reasonable to believe the Petitioner’s Home of Record should be . There is no apparent administrative error other than possibly lack of communication and review by both Petitioner and Navy (MEPS) personnel during military entry. The Board noted that the separation documentation was prepared based on the enlistment document, which did not factor in her husband’s assignment to based on military orders. The Board concluded in light of the her husband’s military orders and Petitioner’s personal and family history would be logical Home of Record upon entry in the U.S. Navy, and therefore relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s DD Form 4/1, (Enlistment/Reenlistment Document, Armed Forces of the United States) effective March 3, 1993, Block 3: (Home of Record) reads “, ” vice “”. Petitioner’s DD Form 1966/1, (Record of Military Processing – Armed Forces of the United States), Block 5: (Home of Record Address) reads “” vice “Same as Item 4”. Issue DD Form 215 in order to correct Block 7b: (Home of Record at Time of Entry) to “ ” vice “” of DD Form 214 issued on May 9, 1995. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
