Pursuant to the provisions of reference (a), Petitioner, a former enlisted member of the Navy, filed enclosure (1) requesting an administrative change to his Report of Separation from Active Duty (DD Form 214N) to reflect his correct date and place of birth. Enclosures (1) and (2) apply. 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 31 July 2019, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service and medical records, applicable statutes, regulations, policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interests of justice to review the application on its merits. c. The Petitioner enlisted in the Navy and began a period of active service on 25 April 1973. On 23 April 1976, Petitioner was released from active duty and transferred to the Naval Reserve. At the time of his discharge, he was issued a report of Separation from Active Duty (DD Form 214N) indicating his birthdate as . d. Petitioner was born in and adopted by an American family at the age of three. Petitioner used the date of birth when he enlisted in the Navy, which was the date provided to him by his adoptive parents. While filing for Social Security retirement benefits in 2016, Petitioner discovered the discrepancy with his date and place of birth. e. Petitioner requested and obtained a copy of his full file in December 2016. The P, and Certificate of Naturalization all state as Petitioner’s birthday. The Petitioner provided copies of all three documents, as well as a issued driver’s license reflecting the to the Board for consideration. CONCLUSION: Upon review and consideration of all the evidence of record, the Board concludes that Petitioner’s request warrants relief. Notwithstanding the recommended corrective action below, the Board did not grant additional relief as requested by Petitioner, namely to change his place of birth on his DD Form 214N. The Board noted that the place of birth does not appear on a DD Form 214N, DD Form 214, or other equivalent military discharge documents. The only address that appears on certain discharge documents is a “home of record” at time of entry into active duty, which is not applicable in this case. RECOMMENDATION: In view of the foregoing, the Board finds the existence of an error warranting the following corrective action. That Petitioner be issued a “Correction to DD Form 214, Certificate of Release or Discharge from Active Duty” (DD Form 215), to indicate that his date of birth is changed to “.” That no further changes be made to Petitioner’s record. That a copy of this report of proceedings be filed in Petitioner’s naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner's application was received by the Board on 12 June 2019. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
