Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner met all requirements for and received an Enlistment Bonus for Source Rate (EBSR). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 23 June 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 30 January 2015, COMNAVCRUITCOM message (Active Duty Enlistment Bonus (EB) and Enlistment Loan Repayment) was published with the following incentive: For individuals entering the Delayed Entry Program (DEP) on or after 1 February 2015. Are eligible for the EBSR in these ship months and fiscal year(s): MMS-5YO, February- June, FY15, $5,000. c. On 18 March 2015, Petitioner enlisted for 8 years in the U.S. Navy Reserve. d. On 13 April 2015, NAVCRUIT 1133/52 (Annex “B” to DD Dorm 4 was 18 March 2015) was published and acknowledged by Petitioner with the following options: Machinist's Mate (MMS/SYO) Class "A" School Guarantee T+X (SUBVOL), and EBSR for $5,000 bonus. e. On 20 May 2015, Petitioner entered active duty. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner met the basic eligibility criteria to receive the EBSR; however, due to administrative oversight, Petitioner failed to receive EBSR. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner received an EBSR ($5,000) after meeting all requirements. Note: Petitioner will take this decision letter to his command servicing Personnel Support Detachment to execute payment. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
