Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received Operational Submarine Duty Incentive Pay (OPSUBPAY) from 18 February 2018 to 4 June 2018. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 21 July 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), states that in this instruction, the term “operational submarine duty” means duty while attached under competent orders to a submarine, while serving as an operator or crew member of an operational submersible (including an undersea exploration or research vehicle), while undergoing training preliminary to assignment to a nuclear-powered submarine, while receiving instruction to prepare for assignment to a nuclear-powered submarine, while receiving instruction to prepare for assignment to a submarine of advanced design, while receiving instruction to prepare for a position of increased responsibility on a submarine, or, in the case of a member qualified in submarines, while attached as a member of a submarine operational command staff whose duties require serving on a submarine during underway operations, and meets the underway requirements specified below. c. On 16 August 2017, Petitioner was issued official change duty orders (BUPERS order: 2287) to . d. On 5 January 2018, Petitioner transferred from his unit . e. On 19 February 2018, Petitioner arrived to for temporary duty under instruction. f. On 23 April 2018, Petitioner arrived to for duty. Furthermore, on the same day Career Sea Pay was started. g. On 5 June 2018, Submarine Pay was started. h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that upon arrival to undergoing training preliminary to assignment to a nuclear-powered submarine, Petitioner was entitled to receive Operational Submarine Duty Incentive Pay (OPSUBPAY). However, due to administrative oversight, Petitioner’s Submarine Pay started upon arrival to his duty station. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner received Operational (OPSUBPAY) Type 2 from 19 February 2018 through 4 June 2018. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
