Pursuant to the reference, Petitioner former enlisted member of the Marine Corps, filed enclosure (1) with this Board requesting correction to his Certificate of Release or Discharge from Active Duty (DD Form 214) to reflect a grade of E-4 and the following awards: Armed Forces Service Medal, Kuwait Liberation Medal, and any additional medals due to him. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 4 March 2020, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner enlisted in the Marine Corps and began a period of active service on 30 August 1989. On 1 October 1990, Petitioner was promoted to the rank/grade of LCPL/E-3. On 29 August 1993, Petitioner was discharged with an honorable characterization of service upon the completion of his enlistment. Petitioner’s was issued a Certificate of Release or Discharge from Active Duty (DD Form 214) which reflects a rank/grade of LCPL/E-3. d. Petitioner’s Certificate of Release or Discharge from Active Duty (DD Form 214) reflects entitlement to the following awards: National Defense Service Medal Combat Action Ribbon Southwest Asia Service Medal (2 Stars) Humanitarian Service Medal Kuwaiti Liberation Medal Good Conduct Medal Navy Unit Commendation Sea Service Deployment Ribbon (1 Star) e. On 4 October 2017, Navy Personnel Command (NPC) PERS 312 reviewed the official military personnel file of Petitioner and determined the Petitioner was entitled to the following awards: Armed Forces Service Medal National Defense Service Medal Combat action ribbon Southwest Asia Service Medal (2 Stars) Humanitarian Service Medal Kuwaiti Liberation Medal Good Conduct Medal Navy Unit Commendation Sea Service Deployment Ribbon (1 Star) CONCLUSION: Upon review and consideration of all the evidence of record, with regard to the Petitioner’s request for his DD Form 214 to reflect the grade of E-3. The Board concluded the Petitioner’s request of adjustment to his grade did not warrant relief as there is no indication that the Petitioner was discharged at the grade of E-4. However, in light of the NPC PERS 312 awards review, the Board determined that the Petitioner’s request warrants partial relief, by adding the following award: Armed Forces Service Medal RECOMMENDATION: In view of the above, the Board directs the following corrective action: That Petitioner’s be issued a Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215) for the period ending 29 August 1993, to indicate the addition of the following award: Armed Forces Service Medal That a copy of this report of proceedings be filed in Petitioner’s naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received by the Board on 28 December 2018. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy.
