Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received a Fiscal Year 19 (FY19) Selective Reenlistment Bonus (SRB). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 13 October 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 6 September 2011, Petitioner entered active duty. c. On 26 October 2014, Petitioner reenlisted for 4 years and 11 months. Petitioner’s End of Current Contract (ECC) was 25 September 2019. d. In accordance with reference (b), this bulletin announces the SRB program and the BSSRB program authorized for FY19. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2018 are eligible for the FY19 SRB program. This will include any regular component first term or career Marine with an ECC from 1 October 2018 to 30 September 2019. Zone B PMOS bonus payments for Marines who reenlist for at least 48 months obligated service are authorized as listed below in dollars (bonuses for Marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.j). Furthermore, PMOS 0211LM E6 & above is listed at $50,000. e. On 1 January 2019, Petitioner was promoted to E-6. f. In accordance with reference (c), the FY19 SRB program will be terminated 30 days (28 June 2019) after the release of this MARADMIN. Marines with an ECC during FY19 will no longer be eligible for an SRB. A FY19 ECC is defined as any Marine who has an ECC on the date of reenlistment between 1 October 2018 and 30 September 2019. g. On 6 June 2019, Petitioner signed a NAVMC 11537 (Reenlistment Extension Lateral Move (RELM) Request, requesting a 48 month lateral move reenlistment into the 0211 MOS. The request was approved by his Commanding Officer on 26 June 2019. h. On 3 July 2019, Petitioner’s RELM request was submitted to Headquarters, U.S. Marine Corps, and on 10 September 2019, Petitioner’s request was approved. i. On 23 September 2019, Petitioner reenlisted for 4 years. j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner submitted his reenlistment request prior to termination of the bonus, however Petitioner’s command did not forward the request in a timely manner. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 26/27 June 2019, vice on 22/23 September 2019 with a term of 4 years and 3 months. Note: This change will entitle the member to a zone “B” SRB for MOS 0211LM upon successful completion of the training requirements, which is capped at $50,000 for 48 months of additional obligated service. Remaining obligated service to 25 September 2019 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
