Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was credited with career sea time previously earned and career sea pay (CSP) adjusted accordingly. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 6 April 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 7 August 2003, Petitioner entered active duty. During this period, Petitioner was assigned to the from 7 December 2003 to 1 December 2006. Petitioner was released from active duty and transferred to the Navy Reserve after reduction in force on 6 October 2009. Petitioner’s DD Form 214 listed 2 years, 11 months, and 25 days of sea service. c. On 28 August 2010, Petitioner was discharged upon completion of military service obligation (MSO). d. On 13 January 2011, Petitioner reenlisted for 2 years in the U.S. Naval Reserve. e. On 13 June 2011, Petitioner entered active duty, and was released from active duty for training (ADT) after completing required active service on 30 September 2011. Petitioner’s DD Form 214 listed 0 years 0 months, and 0 days of sea service. f. On 22 October 2012, Petitioner reenlisted for 6 years in the active U.S. Navy. g. On 12 April 2018, Petitioner was assigned to the Furthermore, Petitioner began to receive Career Sea Pay. h. On 1 March 2019, Petitioner transferred. Furhtermore, Petitioner’s Career Sea Pay stopped. Currently, Petitioner’s sea duty counter reflects 320 days. i. On 1 February 2021, Petitioner reenlisted for 5 years in the active U.S. Navy. j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2) and reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that upon his return to active duty in 2018, due to administrative oversight, Petitioner’s Sea Duty Counter was reset. There’s evidence that Petitioner was not credited with career sea time for the time he was assigned to the from 7 December 2003 to 1 December 2006 causing Petitioner to receive incorrect CSP. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s Sea Duty Counter was updated upon Petitioner’s return to active duty in 2012 in accordance with DD Form 214 effective 6 October 2009. Note: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy. 5/4/2021 Deputy Director
