Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting his naval record be corrected to establish entitlement to Enlistment Bonus for College Credit (EBCC). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 30 March 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a.In accordance with reference (b), if a Sailor’s contract contains and EBCC and the Sailor changes rating/program any time before or after they access onto active duty the Sailor will remain eligible for the EBCC. Payment for Sailors in SG program will be processed upon graduation from “A” school. b. In May 2004, Petitioner completed 162 semester hours at College. c. On 19 September 2007, Petitioner enlisted in the U.S. Navy for a term of 8-years of which 4 years is considered an Active Duty Obligation. Enlistment Guarantee – Annex “A” listed Engineman Class A School SG-EN and Bonus for College Credits $7,000.00. d. On 27 September 2007, Petitioner reclassified and issued NAVCRUIT 1133/52, Enlistment Guarantee – Annex “B” listing Cryptologic Technician (Technical) Class A School SG-CTT and Loan Repayment Program $65000.00. e. On 20 November 2007, Petitioner reclassified and issued NAVCRUIT 1133/52, Enlistment Guarantee – Annex “C” listing Cryptologic Technician (Technical) Class A School SG-CTT and Bonus for College Credits $7000.00. f. Petitioner’s Active Duty Service Date was 20 November 2007. g. On 17 December 2007, Petitioner reclassified and issued NAVCRUIT 1133/52, Enlistment Guarantees – Annex “D” listing Boatswain’s Mate (BM/SG) School Guarantee and Enlistment Bonus (EBCC) College Credits $7000.00. h. Petitioner completed Boatswain’s Mate School on or about 12 March 2008. i. On 19 November 2012, Petitioner was released from active duty and transferred to the Navy Reserve to complete his military service obligation. j. On 18 September 2015, Petitioner was discharged from the Navy Reserve. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the basic eligibility criteria for EBCC in accordance with reference (b). However, in correspondence attached as enclosures (2) and (3) from the offices having cognizance over the subject matter addressed in Petitioner’s application has commented they were unable to validate the EBCC payment; therefore, the Board felt, under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was authorized payment of $7,000 EBCC upon graduation from Boatswain’s Mate School. Note: Defense Finance and Accouting Service will complete an audit of Petitioner pay record to determine entitlement to EBCC payment. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy. 5/4/2021 2
