Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to retroactively change rank due to under calculation of creditable experience at time of commissioning. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 2 February 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, she exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 26 January 2000, Petitioner entered active duty in the U.S. Air Force. b. On 25 February 2004, Petitioner was released from active duty and transferred to the U.S. Air Force Reserve (USAFR) to complete her military service obligation. c. On 21 December 2007, Petitioner was discharged from USAFR. d. On 13 May 2011, Petitioner graduated from the with a e. Petitioner was employed with the from 5 July 2011 through 10 February 2017. f. On 2 December 2011, Petitioner attained Associate Clinical Social Worker license from Board of g. On 26 July 2013, Petitioner attained license from the h. On 18 January 2017, Petitioner signed NAVPERS 1000/4, Officer Appointment Acceptance and Oath of Office a Lieutenant Junior Grade (LTJG)/O-2E with blocks 14 and 16 (Permanent Grade Date/Present Grade Date) reflecting “14FEB15”. i. On 1 October 2017, Petitioner was promoted to Lieutenant (LT)/O-3E j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has partial merit and warrants partial favorable action CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following partial corrective action. The Board determined Petitioner erroneously received entry grade credit (EGC) for time prior to obtaining her Clinical Social Worker licensee. However, in accordance with reference (b), Petitioner met the eligibility criteria for EGC from 26 July 2013 to 10 February 2017 and 2 additional years for qualifying degree, totaling 3 years, 9 months and 7 days of EGC. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, partial relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s NAVCRUIT 1070/3, Medical Service Corps Entry Grade Credit Worksheet is amended to reflect: Item 3 Period as “07/26/2013 to “02/10/2017”vice “03/01/2012 to 01/29/2016”, and Credit Given as “1-year, 9-months and 7-days” vice “1-year, 11-months and 14-days”. Total Service Credit is “3-years, 9-months, and 7-days” vice “3-years, 11-months, and 14-days”. Petitioner’s NAVPERS 1000/4, Officer Appointment Acceptance and Oath of Officer dated 18 January 2017 is amended to reflect: Block 14 (Permanent Grade Date) “3 May 2015” vice “15 February 2014” and Block 16 (Present Grade Date) “3 May 2015” vice “15 February 2014. Note: Petitioner was commissioned as LTJG/O-2E. Petitioner promoted to LT/O-3E effective “3 May 2017” vice “1 October 2017.” Note: This change may have affected Petitioner's opportunity to participate in selection board for Lieutenant Commander/O-4. To remediate the missed opportunity, Petitioner may contact Navy Personnel Command (PERS-801) at 910-874-4526 to inquire about submitting a request for a Special Selection Board (SSB). Information pertaining to SSB can be found at https://www.mynavyhr.navy.mil/Career-Management/Boards/Special-Boards/ and to submit an SSB, email to NPC_Officer_SSB.fct@navy.mil. Defense Finance and Accounting Service will complete an audit of Petitioner’s pay records to determine if Petitioner is due retroactive pay and allowances entitlement. The part of Petitioner’s request for corrective action that exceeds the foregoing is denied. Petitioner is not eligible for constructive service credit prior to attaining Clinical Social Worker licensure per reference (b). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
