Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to change pay grade from “E3” to “E4”. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 1 October 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner’s Armed Forces Active Duty Base date was 15 August 1988. b. On 1 October 1989, Petitioner was promoted to Lance Corporal (LCpl)/E3. c. On 20 December 1991, Petitioner was assigned to , . d. On 22 June 1992, Petitioner and unit Personnel Officer, sign NAVMC 11060, Separation/Travel Pay Certification for pending separation travel/leave for period of 14 July 1992 – 14 August 1992. e. Petitioner’s Official Personnel Military File contains signed Promotion Certificate for promotion to Corporal effective 1 July 1992. f. On 14 August 1992, Petitioner released from active duty as LCpl/E3 and transferred to Individual Ready Reserve (IRR) to complete military service obligation. g. On 30 September 1992, Marine Corps Reserve Support Command conducted Basic Individual Record (BIR) audit upon Petitioner joining the IRR. The BIR indicates Petitioner’s present grade as E3. h. On 13 October 1995, Petitioner was honorably discharged. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner’s service record reflects he was promoted to Corporal/E4 prior to release from active duty on and therefore, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s DD Form 214, Certificate or Release or Discharge from Active Duty dated 14 August 1992 is amended to reflect Block 4a. (Grade, Rate or Rank) “Cpl” vice “LCpl”, Block 4b. (Pay Grade) “E-4” vice “E-3” and Block 12h. (Effective Date of Pay Grade) “92 07 01” vice “89 10 01”. Petitioner’s DD Form 256, Honorable Discharge Certificate of 13 October 1995 reflects rank as Corporal. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
