Dear : This is in reference to your application for correction of your naval record pursuant to Title 10, United States Code, Section 1552. After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 3 September 2020. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. On 29 August 1985, you entered active duty. On 10 August 1995, you were commissioned as an Ensign in the inactive U.S. Naval Reserve with a designator code of 1975. On 11 August 1995, you began your academic year via the Armed Forces Health Professions Scholarship Program (AFHPSP). You conducted 4 midshipman cruises (15 May 1996 to 29 June 1996, 1 May 1997 to 14 June 1997, 14 August 1998 to 27 September 1998, and 12 February 1999 to 28 March 1999) for a total of 6 months. On 1 April 1999, you were appointed as a Lieutenant in the active U.S. Naval Reserve with a designator code of 2105. On 30 April 2020, you retired from the U.S. Navy. You requested 6 months of active duty while in the Armed Forces Health Professions Scholarship Program (AFHSP) be credited for retirement purposes; the Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that in accordance with the Navy’s statement of service dated 12 February 2020, the 6 months earned during your midshipman cruises were credited, for a total of 31 years, 5 months, and 19 days. Furthermore, per the Master Military Pay Account, your retired pay is based on 31 years, 5 months, and 19 days. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
